Memang aku pun tak nak pk pasal Singapork ini, walaupun kadangkala aku jumpa gak ngan polis-polis Singapork yang tak sedar diri ini... .... tapi ko pun patut buat benda yang sama.... tak yah ler nak kutuk-kutuk JB... ko duduk jer diam-diam kat Singapork tu....

KUALA LUMPUR: The Employment Act 1955 will be strengthened with a provision to prevent sexual harassment against women at the workplace.

PEKERJA Sosial Pertubuhan Pertolongan Wanita (WAO), Saralah Mahendran (gambar) berkata, penderaan terhadap wanita boleh disifatkan sebagai sebahagian kecil daripada masalah lebih besar kerana bukan semua kes penderaan itu di bawa ketengah. Malah, ada wanita yang sanggup mendiamkan perkara berkenaan demi maruah suami dan sayang kepada anak.

Katanya, pertubuhan yang kini berusia 25 tahun itu bertindak sebagai pertubuhan sosial bagi membantu mangsa penderaan suami atau teman lelaki, tidak kira membabitkan warga tempatan mahupun luar.

Tujuan utama pertubuhan itu adalah untuk memberi perlindungan kepada mangsa dera dan bagi membantu mereka mendapatkan kembali keyakinan diri untuk menempuhi kehidupan mendatang.

Selain itu, mangsa dera yang berada di bawah kawalan pertubuhan itu akan diberi tempat perlindungan sementara. Sepanjang berada di tempat perlindungan ini, mangsa akan terbabit dalam sesi kaunseling yang mana akan dikendalikan oleh pekerja pertubuhan berkenaan.

揔ami tidak menyediakan rumah perlindungan tetap, sebaliknya selepas tamat sesi kaunseling di tempat perlindungan itu, mangsa masih boleh menetap di situ sementara mencari tempat tinggal yang lain. Pertubuhan ini adalah antara usaha yang dilakukan untuk membantu mangsa dera menempuhi kehidupan yang berbeza daripada sebelumnya.

揃agaimanapun, jangan ingat mangsa dera daripada golongan tidak berkemampuan saja, sebaliknya ramai juga dikalangan yang berada turut mendera isteri dan di sinilah mereka menumpang kasih.

揃erdasarkan pengalaman saya, walaupun selalunya penderaan ini mendorong kepada perceraian, anda perlu tahu bahawa ramai di kalangan mereka kini yang semakin berjaya dengan kerjaya dan perniagaan selepas bangkit daripada pengalaman hitam itu,

Pindaan Perlembagaan Persekutuan, lima akta, satu rang undang-undang

KUALA LUMPUR: Kerajaan akan meminda Perlembagaan Persekutuan, lima akta dan satu rang undang-undang bagi menghapuskan diskriminasi terhadap wanita.


Setiausaha Parlimen Kementerian Pembangunan Wanita, Keluarga dan Masyarakat, Datin Paduka Chew Mei Fun (gambar), berkata akta yang dikaji untuk pindaan adalah Akta Keganasan Rumahtangga 1994, Akta Kerja 1955, Akta Perhubungan Perusahaan 1967, Akta Keselamatan dan Kesihatan Pekerjaan 1994 serta Akta Membaharui Undang-Undang (Perkahwinan dan Perceraian) 1976.

Beliau berkata, rang undang-undang yang dikaji membabitkan Rang Undang-Undang Keluarga Islam (Wilayah-Wilayah Persekutuan).

Katanya, tindakan itu selaras pindaan Perkara 8(2) Perlembagaan Persekutuan yang menetapkan tiada undang-undang dan peraturan harus mendiskriminasikan wanita.

"Cadangan pindaan ke atas Akta Keganasan Rumahtangga 1994 antara lain memperuntukkan peluasan takrifan keganasan rumah tangga supaya meliputi aspek emosi, mental dan psikologi.

"Ia juga bagi memudahkan proses permohonan Perintah Perlindungan Sementara (IPO)," katanya menjawab soalan Senator Datuk Rhina Bhar di Dewan Negara, semalam.

Rhina bertanya sama ada kerajaan mahu memansuhkan akta yang mendiskriminasi wanita yang belum dibuat walaupun Perkara 8 Perlembagaan Persekutuan yang sudah dipinda memberi hak saksama kepada golongan itu.

Menjawab soalan tambahan Senator Datuk Dayang Mahani Tun Ahmad Raffae yang mahu mengetahui bila pindaan itu akan dibuat, Chew berkata, Akta Keganasan Rumahtangga kini pada peringkat akhir.

"Akta Kerja juga dalam peringkat tindakan manakala yang lain dalam perbincangan," katanya.

Kepada soalan tambahan Senator Datuk Gooi Hoe Hin yang mahu tahu bila pindaan Perlembagaan Persekutuan akan dilakukan, Chew berkata, satu jawatankuasa antara agensi yang dipengerusikan Jabatan Peguam Negara ditubuhkan selepas dipersetujui Perdana Menteri, Datuk Seri Abdullah Ahmad Badawi pada Mesyuarat Kabinet Kesaksamaan Gender, Julai tahun lalu.

PUTRAJAYA: Employers will face a RM10,000 fine if they fail to act or investigate complaints of sexual harassment in the workplace.

The fine is part a provision to compel employers to use the current Code of Practice to prevent and eradicate sexual harassment at workplaces.

"This will ensure all employers treat sexual harassment cases seriously and investigate all complaints of such nature," Human Resources Minister Datuk Seri Dr Fong Chan Onn said.

He said the new provision would be incorporated into the Employment Act 1955 under a proposed amendment that was now with the Attorney General抯 (AG抯) Chambers.

He said the lukewarm response by employers in adopting the code of practice had prompted the Government to better protect workers, especially the more than four million women employees in the country.

"Since the code of practice to prevent sexual harassment was introduced in 1999 only 1,225 employers adopted and used it," he told reporters after the weekly Cabinet meeting here Wednesday.

He said the amendments would also compel employers to have an in-house mechanism to hear and investigate complaints of this nature.

Dr Fong said employers who fail to adopt and use the code of practice would be liable to a fine of RM10,000.

Since 2001 women抯 groups had been calling for a bill to compel employers to prevent sexual harassment at workplaces.

The final draft of the amendments to the Act had been submitted to the AG's Chambers three months ago for approval before tabling it in Parliament, said Dr Fong.

"I hope the AG抯 Chambers will approve the amendments as soon as possible for us to move forward," he said, adding that the Government viewed sexual harassment at workplaces as a serious issue.

He said this, however, would not prevent the harasser or offender from being charged in court.

But how do you defined an act as a sexual harassment?

I went on an Ethical Training, last month, and from what we've learned that, in some Co, a simple pat on the shoulder by a person from a different gender is considered as 'a sexual harrasment', which bring us to the question, who is to determine, when sexual harrasment happen, the accuser or the abuser

you see, what a women considered as a sexual harrasment, is maybe for the men, just a gesture that happened spontaneusly, like when sharing a joke, bertempuk tampar

It all depends on ur tolerence level and u can gauge sexual harrasment from body language some ladies dont like vulgar kokes if she specifically tells you stop the vulgar jokes and u still continue to do so then it is sexual harrasement

Some ladies on the other hand dont like to be touched even though just a pat on the shoulder, same rule applies there as well

is it fair to give the right to define an act as a sexual harrasment soley on a women?

am a women by the way, just that sometimes I just find that its still a grey area though, a person can just be in a bad mood today, so what was oke yesterday, might be deemed as a sexual harassment today

while I do agree that more and better laws are in place to protect a women rights, a better stipulated buletin as to what does it constitute should be in place

Majikan tolak pindaan akta tentang gangguan seks

KUALA LUMPUR:  Persekutuan Majikan Malaysia (MEF) hari ini menolak cadangan kerajaan untuk meminda Akta Pekerjaan 1955 yang bertujuan mendenda majikan tidak kurang daripada RM10,000 di atas kegagalan mereka menyiasat laporan mengenai gangguan seks di tempat kerja.

Presiden MEF, Datuk Azman Shah Harun berkata undang-undang sedia ada seperti Kod Amalan Pencegahan dan Pembasmian Gangguan Seks di Tempat Kerja sudah memadai bagi menangani isu tersebut.

Kod berkenaan diperkenalkan Kementerian Sumber Manusia dan dilaksanakan secara sukarela oleh majikan.

"Ia merupakan garis panduan yang praktikal untuk majikan mewujudkan mekanisme dalaman bagi menangani masalah gangguan seks di tempat kerja. Ia juga bertindak sebagai garis panduan kepada majikan, kesatuan sekerja dan pihak-pihak lain berhubung melindungi maruah di tempat kerja," katanya dalam satu kenyataan hari ini.

Semalam Menteri Sumber Manusia Datuk Seri Fong Chan Onn berkata cadangan peruntukan baru itu bertujuan membanteras gangguan seks di tempat kerja dan supaya majikan bertindak tegas menanganinya.

Azman Shah berkata penderaan seks juga termaktub di bawah Seksyen 14 Akta Pekerjaan 1955 sementara di bawah Akta Keselamatan Pekerjaan dan Kesihatan 1994, terdapat peruntukan yang menetapkan tugas majikan untuk menyediakan suasana pekerjaan yang selamat dan tanpa berisiko.

"Sementara gangguan seks telah dibincangkan pada mesyuarat Majlis Penasihat Buruh Kebangsaan, MEF tidak bersetuju ia dijadikan sebagai sebahagian cadangan pindaan kepada Akta Pekerjaan," katanya

pada saya memang patut ada akta pindaan untuk menyaman
employer yang terlibat dalam sexual harassment at work --

in fact, it should be implemented long ago --- considering many
employees already been harassed sexually either directly or
indirectly at work ---

hopefully shahrizat will fight for this cause -- to protect women
at work force -
