Sultan Sabah Bakar Bendera Sabah!

  Sabah flag-burning case postponed to May 20

LAHAD DATU: The trial involving the self-proclaimed sixth sultan of North Borneo Abdul Rajak Datu Aliuddin and 11 others for illegal assembly and burning of Sabah flags will resume on May 20.

The 12 of them had claimed trial before the magistrate's court here when the matter was brought up last week.

They were arrested on April 4 last year after they were involved in an illegal assembly at Lahad Datu before burning of at least three Sabah flags at separate locations in town.

They allegedly then marched to the district police headquarters in old Custom Road here where they were later arrested and detained.

Investigations revealed that one of them, Junior Oribello, was an illegal immigrant and was handed over to the Immigration Department for deportation to his country of origin before the trial begun.

As such only 11 of the accused, including Abdul Rajak are on trial  for illegal assembly under Section 143 of the Penal Code. They also face the same charge  under Section 27(5)(a) of the Police Act, 1967.

The 11 accused are  Abdul Rajak Bin Datu Aliuddin, his brothers Abdul Pasaran Aliuddin and Jul Asri Datu Aliuddin, nephew Amiru Datu Pelair and Nizam Asyikim Abdul Wahab, Mohd Isa Sally Panut, Mohammad Hafiz Jaffar, Hazrul Jaffar, Mohiddin Musidih, Jifri Nunui and Puleh Karim.

Abdul Rajak, Abdul Pasaran and Jus Asri with another Mohammad Hafiz face a second charge under Section 435 of the Penal Code for destroying property worth RM50 and above in public places.

At the start of the trial at the magistrate court the accused shook their heads and said “Tak bersalah" (not guilty) when magistrate Amir Shah Bin Amir Hassan asked how did they plead when the charges were read to them.

Witnesses called by deputy public prosecutor Niat Andi Sanrang testified against the accused over four days, beginning April 20.

Three testified on the first day of the trial, two the following day, four on the third day and one in Friday.

The 11 are being defended by the legal firm MS Amin Jaafar and Co whose lawyers requested anonymity due to the sensitivity of the case.

'You can't stop us'

During the trial district police special branch Sergeant Konsul Pasauh told the court that on that day of the incident at about 8am, he received a call from his superior Chief Inspector Shahzuan Abdullah that a group of people led by Abdul Rajak were planning an illegal assembly in front of a bookstore in the town.

“When I reached the location (Sabah bookstore) at 9.15am, I saw a group of about 12 men standing on a road divider between the bookstore and the Milimewah shopping mall.

“One of them I identified as Datu Jul Asri Bin Datu Aliuddin was setting alight a Sabah flag with a lighter in his hand,’ he told magistrate Amir Shah.

Three minutes later the group left the flag which was still burning on the road divider and walk toward the central market. They didn’t shout any slogans but raised three yellow flag with red lion symbol, he said.  

Another witness, Corporal Khairul testified when he asked the group to show their permit for the gathering but one of them is believed to have pointed his finger at their patrol car and shouted “Kami keturunan sultan, Kamu tiada kuasa atau hak menghalang kami (we are the descendant of the sultan, you all have no power and right to stop us)’.

The man later repeatedly hit the vehicle's bonnet with his fist, he said.

Magistrate Amir Shah adjourned the proceeding to May 20-21 when DPP Niat is expected to call another two witnesses.

If found guilty, the 11 face jail terms of not more than six months or fine of between RM2,000 and RM10,000 or both, while under the Police Act they face a fine or imprisonment of not more than a year.

Abdul Rajak  Abdul Pasaran, Jus Asri Bin Alliuddin and Mohammad Hafiz also face a jail term of up to seven years or a fine if found guilty on the second charge under Section 435 of the Penal Code for destroying property in public places.

SULTAN SABAH DITANGKAP BERSAMA 11 PENGIKUT?

SEORANG lelaki berbangsa Suluk, Datu Abdul Razak Datu Aliuddin, 41, ditahan bersama 11 orang pengikutnya setelah mereka mengadakan perhimpunan haram dan bertindak membakar enam bendera Sabah di hadapan Pasaraya Milimewa dan Pasar Rakyat, Lahad Datu sekitar jam 8.30 pagi tadi (Sabtu).

Mengikut fakta kes, kesemua mereka berkumpul di hadapan Pasaraya Milimewa untuk menarik perhatian orang ramai sebelum bertindak nekad membakar bendera Sabah sebelum bergegas ke Pasar Rakyat untuk melakukan perkara yang sama sebaik sahaja mendapati ramai orang berkumpul dan bersorak apabila tiga lagi bendera Sabah dibakar.

Tidak cukup dengan itu, mereka bergegas ke Ibu Pejabat Polis Lahad Datu dengan tujuan yang tidak pasti tetapi dipercayai untuk mencabar polis menangkap mereka tetapi mereka tidak dapat masuk ke balai setelah polis yang bertugas menahan mereka di pintu masuk setelah menerima maklumat daripada polis yang menyaksikan mereka melakukan kegiatan berkenaan.

Menurut Ketua Polis Derah Lahad Datu, Mohammad Suhaimi Abdul Rahman, kesemua mereka ditangkap dan ditahan di Balai Polis Lahad Datu untuk siasatan polis.

Kesemua mereka adalah wargananegara Malaysia kerana memiliki mykad berumur antara 18 hingga 41 tahun yang tinggal di sekitar daerah Lahad Datu.

“Kita masih menyiasat apa motif mereka dan kenapa mereka melakukkannya,” ujar Suhaimi  yang memberitahu bahawa kesemua mereka disiasat di bawah Seksyen 143 (Akta 574), Kanun Keseksaan iaitu mengadakan Perhimpunan Secara Haram.

Jika sabit kesalahan kata Suhaimi, mereka akan dipenjara selama enam bulan atau dengan denda atau kedua-duanya sekali.

“Kita telah menempatkan 80 anggota polis untuk mengawal keadaan dan sebagi langkah berjaga-jaga. Saya menasihati orang ramai jangan percaya kepada sebarang khabar angin dan menyerahkan kes ini kepada kebijaksanaan polis,” ujar Suhaimi yang melaporan keadaan di Lahad Datu adalah terkawal.

Dalam pada itu, Abdul Razak sebelum ini mengaku sebagai ‘Sultan Sabah’ yang berkuasa penuh ke atas negeri ini dan menggunakan cop mohor dan bendera Kesultanan Sulu telah beberapa kali mendapat liputan media masa tempatan sebelum kejadian ini.
