Akta hasutan yang baru di pinda :

Menjadi satu kesalahan untuk menyebarkan ( cetak semula atau copy paste ) apa saja publication yang berbentuk hasutan , itu termasuk sebar atau share guna facebook , retweet atau WhatsApp , walaupun si penyebar tu bukan pengarang asal publication tersebut sekalipun .

Mereka yang buat dan/atau sebarkan bahan publication hasutan boleh di halang sama sekali dari menggunakan apa saja alat elektronik untuk tujuan itu .

Kalau pencipta publication tu tidak dapat di kenal pasti, maka hakim boleh mengarahkan pencegahan akses masuk ke publication elektronik tu .

Definasi hasutan secara legal adalah samar , dan niat/tujuan langsung tidak di ambil kira untuk sesatu dakwaan hasutan .

Tidak kah bunyinya macam apa saja penyebaran boleh di labelkan sebagai hasutan kalau pihak berkuasa tak suka ?

Dan yang pasti memana forummer yang copy paste news di forum ni turut terdedah kepada akta nih , malah bod ni turut terdedah kepada akta nih sebenarnya.

Camne nak tahu mana news yang ada hasutan dan mana yang tidak , apabila definasi hasutan dalam akta ni samar gitu ?

So hakikatnya kita sendiri tak mungkin tahu news yang kita post tu ok ke tak, bersifat menghasut ke tak ,  tup tup kita dan Cari Forum boleh kena tindakan je bawah akta nih kerana menyebarkannya semata-mata di forum ni ?  ..... Uishhh adil ke gini ?

KUALA LUMPUR, April 11 — The Sedition Act 1948 was expanded to include necessary provisions to protect Malaysians on the Internet, Home Minister Datuk Seri Dr Ahmad Zahid Hamidi suggested today, citing the increase of threats spread on social media as one of the main reasons behind the amendments.

According to The Star Online, the Umno minister, in defending the controversial amendments passed yesterday, said it was time for the colonial-era law to keep up with the times.

“The offences used to only be done through mainstream channels like print and electronic media or ceramah but nowadays, all that can be done on social media,” he was quoted as saying at a press conference at Johor police headquarters.

Zahid also pointed out that although the Penal Code exists to deal with crime, its provisions were insufficient to handle offences committed via social media.
“And that is what the Sedition Act is for,” he was quoted saying.

After a gruelling more than 12-hour debate session, amendments to the Sedition Act 1948 were passed in the early hours of yesterday morning.
Critics of the amendments, including social activists, opposition lawmakers and lawyers, however, believe the changes to the law would see the end of social media.
The Internet, they said, would be turned into a silent place beyond recognition.

This is because the amendments had included replacing the offence of importing seditious publications with the offence of propagating seditious publications.
        
According to civil liberties lawyer Syahredzan Johan, because the Bill does not define “propagation”, the word would typically mean to reproduce, disseminate or spread the publication.
        
“For social media users and those using smartphones, this would mean that a person would be liable if he or she shared on Facebook or WhatsApp or retweeted a seditious publication, even if he or she is not the maker of the said publication,” Syahredzan wrote in an article titled “Sedition (Amendment) Bill — internet users beware!” on Malay Mail Online, referring to social media giant Facebook and mobile messaging app WhatsApp.
        
Social activist Datuk Ambiga Sreenevasan said the proposed prohibition of sharing remarks deemed seditious is a “nasty” way of controlling social media, pointing out that the legal definition of sedition is vague and that intention is irrelevant for a sedition conviction.
        
“What they are unleashing on the Malaysian public is unforgivable and undermines the rule of law. I would go so far as to say they are unconstitutional as any restrictions on freedom of speech must be reasonable and these are not,” Ambiga, who is also a former Malaysian Bar president, told Malay Mail Online.
        
The police have arrested and charged several politicians and activists this year under the Sedition Act for their tweets critical of the establishment.
        
The amendments to the Sedition Act, a colonial-era law, also prohibit those who make or circulate electronic publications deemed seditious from accessing “any electronic device”.  
        
Section 10A of the Bill also states that a judge shall order the prevention of access to an electronic publication deemed seditious if the creator of the publication cannot be identified.

bebentuk hasutan bang. x kn copy paste berita kambing tetelan plastik nk kene dakwa?  bende x sahih jgn sebar..melayu ni suke sebar berita, sahih ke x sebar dlu.

good aku malas dah nak dengor fitnah fitnah. masalahnya rakyat mesia sng percaya tak pandai tapis. apa menteri kata suruh makan najis? kurang bijak punya menteri. padahal depa tatau depa ialah mangsa manipulasi media

Masaalahnya akta tu dikatakan tak define makna hasutan secara fixed dan jitu, samar .

Ditakuti kat bod ni nanti hanya akan wujud news mengenai kambing , kucing, dan sewaktu dengannya aje la kerana hanya itu je yang kita boleh pastikan tak menghasut .

News mengenai lembu besar kemungkinan tak boleh kot sebab kang shahrizat terasa menghasut menci dia plak .

Adakah hasutan hanya termasuk news berbentuk fitnah ? Hasutan = fitnah ?

Atau hasutan = ajakan kepada membenci kerajaan atau pentadbiran kerajaan ?

Kalau hasutan bermaksud ajakan untuk membenci maknanya perkara yang betul pun boleh di kategorikan sebagai hasutan andai ia membawa kepada kebencian , tak gitu ?

Yang bermakna pendedahan penyelewengan kerajaan melalui media cetak dan elektronik tidak dapat di buat langsung lah kerana ia boleh masuk kategori menghasut rakyat benci kerajaan .

Tapi kalau kita kata kebenaran, contohnya konek @stinger_attack dua setengah inci yakni tak nalla (dia sendiri mengaku sumpah wallah adakah di kira hasutan atau hanya 'berkata kebenaran walau pahit'?

The present gov yg patut risau... nanti bila hilang kuasa in 2018... they will not have the means to topple the future gov using the same method that the opposition is currently enjoyed... dah lama opposition enjoyed seditious remarks towards the present gov...dah tertanam perasaan benci... in the next two years just kena siram baja tengok cara Rosmah  dan Najib memboroskan diri dah cukup bg orang bertambah benci pada BN...
