Alasan jer tu. Itu tanggungjaeab dia lh kena gi pjbt lhdn tanya. Takkan tak tau undang2 yg setiap org yg ada pendapatan layak utk membyr cukai. Budak Lara tu pun byr cukai. |

kaveat ni sekatan ke atas aset berbentuk rumah tanah. kaveat sekarang RM 170, tp sebaiknya hire peguam. plus minus RM 1200.
RM 1200 = RM 300(komisyen akak)+ RM 900 ( kos peguam)

Belum bankrupt lagi tu. Baru notis kebankrapan dikeluarkan. Ada few steps lagi untuk bankrupt kalau ...
Hutang lhdn bole declare bankrupt jugak ye? I didnt know that. |

Meh I tolong explain berdasarkan ilmu yang tak seberapa dan dah karat ni sebab i dah pindah department tak buat bankruptcy cases lagi 
LHDN dah obtain satu penghakiman mahkamah (court judgment) against Sam (debtor/penghutang) probably sebab debtor tak bayar income tax and the amount yang dentor tak bayar tu melebihi RM30k, sebab kalau nak failkan bankruptcy hutang tu kena minimum RM30k.
Bila dah obtain court judgement, secara rasminya the debtor ada hutang duit dengan LHDN. Berdasarkan court judgment tersebut, LHDN initiated a bankruptcy proceeding sometime in February this year (sebab the case no ends with 02/2017) as a way to recover balik hutang income tax si debtor ni.
Bankruptcy proceeding ni is initiated by the filing of a bankruptcy notice (notis kebankrapan/ BN) by the creditor/ pemiutang, in this situation LHDN la is the creditor. And bankruptcy notice ni valid for 3 months from the date of issue by the court. So issue in Feb 2017 and will expire in May 2017, LHDN ada masa 3 bulan nak personally serve the BN to the debtor. In this situation, LHDN gagal nak buat personal service so LHDN apply for substituted service to serve the BN to the debtor.
Substituted service(ss) tu la yang korang nampak the iklan BN kat surat khabar yang TT post tu. Perintah ss tu was made by the court on 26 May 2017 sebab tu kat iklan tu ada tarikh 26 May 2017. Tujuan ss tu ialah untuk bagi notis and nak bagitahu debtor la yang ada orang dah initiate a bankruptcy proceeding against you.
BN tu actually is a demand by the creditor for the debtor untuk bayar balik hutang dalam masa 7 hari lepas debtor terima BN tu. Kalau tak bayar dalam 7 hari, the debtor dah commit an act of bankruptcy and the creditor boleh failkan creditor's petition (petisyen pemiutang/ CP) pulak.
Lepas dah failkan CP ada la hearing depan penolong kanan pendaftar mahkamah (PKP) and lepas CP hearing ni PKP akan keluarkan adjudication order and reveiving order (AORO) then barulah seseorang tu jadi bankrap secara rasminya.
Hasil skodengan i kat website efiling, next date for this case is on 28 August so kita tunggu dan lihat apa jadi next. Kalau debtor dah settle semua hutang ok la tak proceed to CP stage. Kalau tak, jaga-jaga silap haribulan jadi bankrap nanti.
I pun pernah gak baca forum kat court masa tunggu CM for case code 38 kat KLHC. Matila ntah-ntah pernah terserempak dengan sesapa kat sini |
