Property law #1: Landowners, beware!

A Thai woman found herself losing her valuable land in Penang, to a con-woman, who forged that Thai woman抯 documents, and sold it to a third party. The Federal Court held that the rights of a bona fide purchaser must be protected. So, she lost her land.[1]

I抦 not going to comment too much on the court抯 decisions except the fact that this is a wrong decision where no one can change it besides the parliament. Many articles are available on this, do your own search on that case reference below, and you should be able to understand the whole case in detail.

It抯 my duty however to share with you few tips on how to save yourself from con-man:


(1) Always engage a trustworthy lawyer ( solicitor ) to represent you

this is a real big problem melibatkan ownership of land skrg.. it happened to one of the property that my company bought.. diaorg ni sgt efisyen sampai court order pun diaorg boleh forged. Belum sempat kitaorg nak masukkan caveat, diaorg dah transfer dulu.. we suspek ada 'org dlm' yg terlibat dlm kes ni, or else the land wont get transferred so fast. Skrg kes still pending in court.

So follow the advice and lodge a caveat on your land esp if it is free from encumbrances and VACANT.. normally kes mcm ni terjadi kat vacant land..

I'll be going to a talk on this issue on the 22nd May nanti.. speaker Judith Sihombing.. ada sapa2 berminat nak join?

itu lah.  kalau bona fide transaction, law provides supaya purchaser is protected.  owner kena settle the matter dengan si seller tu sendiri.  jenuh la camni...

biasanya fraud camni, mesti melibatkan orang dalam.  sebab andaiannya ialah lawyers buat land searches dan confirm everything in order sebelum boleh release duit ke seller.  since land searches dibuat di pejabat tanah, sapa lagi yang boleh adjust details supaya printouts tunjukkan seller ada ownership?

pasal choice of lawyers, aku setuju.  walaupun kengkadang kita takde kuasa (kalau untuk housing projects) memilih lawyer, pastikan kita dah jumpa lawyer tu, at least.

psal caveat tu, bukankah boleh suruh je sesapa yang rapat dengan kita untuk masukkan caveat?  tak salah, kan?  anak kita pun boleh (dengan alasan, dia waris kita).

kes mcm ni memang banyak lagi2 sejak sistem berkomputer tanah diperkenalkan...ini belum kira lagi kes salah masuk detail dalam geran oleh kerani PTD yg efisyen tuh....

lepas tu bukan loyer je yg buat transfer skrg ada org PTD yg pasang kaki agen diaorg sendiri utk buat trnsfr ... of course bayar lebih murah sbb tak bayar legal fees.

pada tuan tanah make sure selalu bayar cukai tanah... kalau slip cukai tanah tu dah tak sampai keumah lagi baik check kat PTD mana tahu tanah dah jadi bukan milik kita... loyer lak kene extra precaution sbb aku tengok ada loyer tu tak buat pun land search kat PTD bergantung pada geran je padahal land search tu diaorg caj jugak

KUALA LUMPUR: Polis akan mendedahkan identiti 30 lagi peguam yang disyaki terbabit dalam pelbagai kes berkaitan pecah amanah dan salah guna kuasa membabitkan wang pelanggan berjumlah jutaan ringgit, minggu ini.





Pengarah Jabatan Siasatan Jenayah Komersial (JSJK) Bukit Aman, Datuk Ramli Yusof, berkata pihaknya sudah mengenal pasti identiti peguam berkenaan dan kini menyiapkan laporan penuh sebelum mendedahkannya kepada umum.

elok la diaorg trace penyangak ni... cuma aku takut kang polis lak yg kene saman sbb siarkan gambar diaorg sbb proper charge belum dibuat... alih2 kang loyer tu tak buat pecah amanah tu,  udah kene saman juta2 lak...

aku rasa bar council pun patut buat iklan la nama2 loyer yg dah dipecat dalam surat kabar so org ramai takkan berurusan ngan diaorg lagi

aku setuju dgn cadangan elbecks.. selama ni Bar Council advertise dlm INSAF je (their official magazine), org luar tak dpt nak baca.. bagus jugak kalau advertise kat paper.. so that people will beware and not deal with these bad hats.. merosakkan profession je diaorg nihh..

serius action have to be taken lah, kalau tak macamana org nak percaya kat law firm.. selalunya diaorg jadi stakeholder pegang sampai berjuta2 client's money.. kalau tak honest busuk la legal profession..

btw khairul, that talk tu not that interesting.. tak byk benda baru yg I belum tau.. she gave the talk more on academician punya view.. byk sebut case2 law yg majority of the people there wont be able to remember.. lecture kind of talk lah.. ada certain part ngantuk gak..

rupanya dia ni minah salleh fr oz.. selama ni I dok ingat dia org sabah/sarawak bcoz of the name.. dah tua gak dia ni..
