(New York) – Human Rights Watch mourns the loss of Karpal Singh, a towering fighter for justice and human rights inMalaysia, and in all of Asia. He died in the early morning of April 17, 2014, in an automobile accident as he was traveling between Kuala Lumpur and Penang to attend a court hearing. He was 73 years old.
“Karpal Singh used his keen mind, legal training, and passion for justice to doggedly promote respect for human rights in Malaysia,” said James Ross, legal and policy director. “For decades, he was an unyielding force for the rights of all.”
Known as the “Tiger of Jelutong,” a town he once represented in parliament, Karpal’s tenacity repeatedly landed him in trouble with the authorities. In October 1987, he was detained without trial, along with other opposition lawmakers and political leaders, under the infamous Internal Security Act for allegedly inciting racial dissension. He was released in 1989, and the Internal Security Act has since been revoked. In 1998, he was denigrated for defending the opposition leader Anwar Ibrahim during his first sodomy trial, and again for representing Anwar in a second politically motivated sodomy case.
Karpal Singh’s involvement in opposition politics and his public criticism of the government came at great personal cost. At the time of his death, he was facing a prison term and a fine for alleged sedition for publicly asserting in February 2009 that the decisions of a hereditary ruler could be questioned in court. The court had originally thrown out the charge, but the government brought an appeal that resulted in a fine sufficiently high to force his disqualification from parliament. Just before Karpal’s death, the attorney general applied for a prison term to accompany the fine.
Karpal wins RM2mil in damages over 2005 accident

DAP national chairperson Karpal Singh is one happy man, for he was awarded RM2.018 million in damages by a sessions court in Penang today over the 2005 accident that left him wheelchair-bound.
Judge Chan Jit Li awarded him general damages at RM380,000 and stated other damages as:
Hospitalisation fees – RM399,162.37
Chairlift – RM104,200
Medical supplies – RM12,998.06
Nursing care fee for three nurses – RM135,808
Future nursing care for up to 84 months – RM212,800
Wheelchair – RM40,170
Vehicle – RM276,141.52
Future medication – RM378,000
Travel – RM11,951.98
Future surgery – RM66,666.
Reading out her judgment, Chan said the decision was difficult to make as she did not want to “under- or over-compensate” Karpal, one of the country’s top legal eagles, in this case.

She said that Karpal’s quality of life had been severely compromised after his accident, yet he had continued to live an active lifestyle, with his mental faculties intact.
Karpal, who is Bukit Gelugor MP, met with the accident on Jan 29, 2005, when he was sitting in the rear left seat of a private limousine driven by Soid Abd Ghani from the Bayan Lepas International Airport.
Karpal suffered severe spinal cord injury
Another vehicle driven by one of the defendants, Lau Yee Fuat, was heading towards Karpal’s residence in Jalan Utama when the car collided into the limousine from behind.
NONEKarpal (in wheelchair) suffered severe spinal cord injury, fracture at the C3/C4 invertebral disc, inability to walk or stand and severe pain secondary to spasms, among other injuries.
The damages are to be paid by the defendants, Lau and the limousine company.
After the session, Chan gave Karpal a light hug, out of respect for the well-known lawyer.
Karpal said he was happy with the judgment, that it was fair and he accepted it.
“I’m happy that the judgment is good and fair,” he said.
Karpal was represented by his son Jagdeep Singh Deo, while Lau, who was not present in court today, was represented by Bala Mahesan.
Karpal’s wife Gurmit Kaur, who was also present, was overcome by emotion. She told reporters that she was “thankful to God as the accident could have been worse”.
“God has been good to Karpal. He has been struggling with the pain, but we are taking it one day at a time,” she said.
“Our family and friends and hospital staff have been very supportive of Karpal.
“He is using mind-over-matter in getting work done, and he has not slowed down,” Gurmit added.

We, the Boards of Governors and Managers of St Xavier’s Institution, SK St Xavier’s, and SK St Xavier’s Cawangan are deeply saddened to hear of YB Karpal Singh’s sudden death.
YB Karpal was one of our ‘towering Malaysians’, a most illustrious son, no doubt. He was dubbed the ‘Tiger of Jelutong’, from where he was repeatedly elected into Parliament, before he moved to contest in and to represent Bukit Gelugor, both constituencies in Penang.
YB Karpal was a fearless and renowned lawyer. In and out of Parliament, Karpal spoke out bravely against the making of unjust and bad laws, and opposed policies that discriminated against the down-trodden and minorities and that favoured the cronies and racial or religious exclusivists. He also condemned the use of these bad laws to oppress critics, activists and Opposition leaders.
In this regard he was among those detained without trial under the ISA during Operasi Lalang 1987. He was respected not only among freedom-loving and justice-seeking Malaysians of all races and religions; he was also respected by foreign political leaders and law experts, and international human rights groups. He was proud of his party, the Democratic Action Party, and ultimately served as its National Chairman.
Yet YB Karpal never forgot his roots. One of these roots led back to his alma mater in Penang. In 2009, he was the guest-of-honour at SXI’s annual speech day. In 2011, he came to SXI to speak at the launching of the memoirs entitled ‘The Man from Borneo’, authored by Rev Bro Datuk Michael Jacques fsc, his former teacher.
In 2012, he found time to grace the 160th Anniversary Dinner commemorating the founding of his alma mater in 1852; and later that year, he came to pay his respects and to bid farewell to Rev Bro Datuk Charles Levin fsc, the longest-serving Director of SXI. Indeed, it was Karpal who had nominated the good Brother for datuk-ship honours from the Penang state government. He also donated generously to SXI’s various causes.
And now, we mourn the passing of YB Karpal Singh, too. No doubt, he imbibed many La Salle values, not least our special concern for “the last, the lost and the least”. Karpal’s death is a major loss for our country and Parliament, his party and the democratic struggle, and to our St Xavier’s schools.
May our students and all young Malaysians learn from Karpal’s love, service and dedication to his nation Malaysia, and to people of all faiths and races.
Rest in Peace, dear Sir. God’s Peace and Blessings to you and to your family and friends on this sorrowful occasion.
