Tahniah..DUN Sabah pada hari ini turut mengikut jejak Sarawak.


Sabah passes bill to amend land law to enable tax collection



KOTA KINABALU: The State Legislative Assembly has passed a bill to amend the Land Ordinance, refining the definition of “land” and bringing Sabah closer to getting back its state rights under the Malaysia Agreement 1963 (MA63).

The amendment would also allow the state to collect sales tax on natural resources extracted from its waters.

Assistant minister in the Chief Minister's Department, Arifin Asgali, made the proposal to amend to the Land Ordinance (Cap 68) by refining the definition of land to include the bed of any river, stream, lake or water course, and the area of Sabah's continental shelf.

This extends to the seabed and its subsoil which lies beneath the high seas contiguous to the territorial waters of Sabah, as stated in the North Borneo (Alteration of Boundaries) Order in Council 1954.


“I fully support this enactment as it carries a lot of implications.

“This would allow us to take action on matters involving Sabah's minerals, as well as Petronas and licences (to operate in Sabah), which were not clear to us before.

“This is by far the best change carried out by the current government; congratulations,” said the Sabah STAR president in the state legislative assembly sitting on Thursday (Nov 15).

Balung assemblyman Datuk Osman Jamal from PKR also welcomed the proposal, saying that it reinforced Sabah's absolute power under MA63, in accordance with the election promise made by the ruling coalition in GE14.

Osman added that the enactment would also pave the way for Sabah to collect sales tax for the extraction of resources within its territorial waters.

“The Agriculture and Food Industries Ministry has to pay attention to this enactment and study whether the state has been collecting tax for natural resources extracted from its waters all this while.

“Now that the definition of land has been refined to include areas of Sabah’s continental shelf, there is no law that can prevent us from collecting tax for resources taken from our waters,” he explained.

“Adalah amat menyedihkan bahawa padatahun ini, Sarawak tidak mendapat peruntukan bencana banjir daripada Kerajaan Persekutuan berbanding dengan negeri-negeri lain.

“Begitu juga Sarawak tidak diperuntukkan Pasukan Sokongan Psikologikal untuk memberi khidmat kaunseling kepada mangsa banjir,” katanya pada ucapan penggulungannya bagi Kementerian di Persidangan Dewan Undangan Negeri (DUN) di sini, hari ini.

Petronas suit: Has Dr M agreed?

KUCHING: Petroliam Nasional Berhad (Petronas) yesterday dropped a bombshell in its decision to seek legal redress to its oil and gas rights in Sarawak.

The suit comes two months after the Sarawak government announced that a new regulatory framework over the oil and gas industry would come into force effective July 1.

When the regulatory framework, which is also applicable to Petronas, comes into force, actions and penalties will be taken against any person or company including its contractors, sub-contractors and vendors operating in Sarawak without licences issued by Sarawak government.

The Sarawak government has confirmed that it has been made a party in the suit brought by the national oil corporation and the application for leave made under Article 4(4) of the Federal Constitution would be heard in Putrajaya on June 12.

Assistant Minister of Law, Federal-State Relations and Project Monitoring Sharifah Hasidah Sayeed Aman Ghazali, who confirmed this, said the Sarawak Attorney General’s Chambers had been served with a notice from the Federal Court Registry yesterday.

“The state Attorney General’s Chambers has been served with a notice from the Federal Court Registry on June 4…that the Sarawak government is being made a party in a suit brought by Petronas in the case of Petroliam Nasional Berhad vs Kerajaan Sarawak.

“At the moment, Sarawak has yet to receive the motion filed by Petronas related to the application. The Sarawak government will do everything within its powers, in accordance with the rule of law, to defend our rights in this matter,” she said in a statement received here yesterday.

In an immediate response, political analyst Prof James Chin told The Borneo Post that the court ruling would be “good for everyone as it could provide a guide on the legal arguments on the MA63 (Malaysia Agreement 1963)”.

Chin who is the director of the Asia Institute at the University of Tasmania in Australia said stakes would be high in the Petronas vs Sarawak Government suit.

“Stakes are high. If Sarawak wins, it means Petronas must pay back all previous revenue from not only Sarawak but Sabah as well. If Petronas wins, people in Sarawak and Sabah will be very upset as it goes against PH promises in its election manifesto,” Chin cautioned.

Chin, however, asked who authorised the suit since Petronas is only answerable to the Prime Minister, Tun Dr Mahathir Mohamad.

“Did Dr Mahathir know about the suit?” he asked.

He added that there is actually no need for court case if the new PH government just simply recognise Sarawak and Sabah rights under MA63.
He said the court decision would indicate partly if parliament is supreme or MA63 agreement is supreme.

“This legal move is just the initial stage. It will lead to other areas,” Chin said.

Petronas said it had filed an application before the Federal Court seeking for a declaration on the Petroleum Development Act 1974 (PDA 1974), being the law applicable for the petroleum industry in Malaysia.

It is seeking to clarify that under the law, it is the exclusive owner of the petroleum

resources as well as the regulator of the upstream industry throughout Malaysia, including in Sarawak.

“Petronas believes that the determination by the Federal Court would help provide clarity on its rights and position under the PDA.

“Petronas remains committed to supporting Sarawak’s aspiration to participate in the oil and gas industry in Sarawak, as long as it is within the framework of the PDA,” Petronas said.

patut org sarawak dok kempen gila2 nak kluar dr msia. * arwah adnan satem pun perjuangkan utk kluar dr msia. ( sumber dalaman. sbb tu sarawakian syg sgt kt dia)
sbb petronas dok kaut kekayaan negeri tp depa x seciput.
najib dulu jaga sabah sarawak sbb situlah deposit BN. mau tau laa sifir politik.
pada aku, sbg kerajaan kena adil. sapa2 jadi pun apa yg hak negeri kena pulangkan la semula.

Tak boleh. Sebab PETRONAS wujud atas sebab diberi monopoli penuh pengendalian keatas seluruh sumber minyak dan gas dalam Malaysia. EG: Jumpa minyak dalam tanah sendiri di laman rumah, haram buat rig sendiri, kena panggil PETRONAS sedut minyak. Cumanya sejak azali lagi, wang diberi PETRONAS nampaknya diguna kerajaan untuk benda-benda yang tidak memberi manfaat kepada majoriti penduduk Malaysia.

Ada kebaikan utk PH menang kali ni..

Selama ni, bila kami mengeluh psl isu ni...kena balik kt kami...sapa suruh sokong BN?

so skrg..BN pun dah..PH pun dah...memasing la dh boleh buat penilaiaan.

Tu hari Putrajaya dah tubuh Jawatankuasa kaji MA63...Tapi dibantah oleh Sarawak...sebab senget sangat...Sarawak cuma minta..setup suruhanjaya seperti mana yang telah ditetapkan dalam dokumen MA63..itu pun Putrajaya gagal nak ikut.
Paling sedap dengar...sebarang keputusan akan dimaklumkan 6 bulan kemudian....



Sarawak tolak jawatankuasa kabinet Putrajaya berhubung MA63

Ketua Menteri Abang Johari Openg berkata beliau berpendapat bahawa jawatankuasa itu harus dimodelkan mengikut garis-garis Jawatankuasa Antara Kerajaan (IGC) yang dibentuk pada tahun 1961 untuk melihat pembentukan Malaysia.

SARAWAK mempertikaikan cadangan kerajaan Pakatan Harapan berhubung jawatankuasa khas kabinet untuk menyemak semula Perjanjian Malaysia 1963.

Ketua Menteri Abang Johari Openg berkata beliau berpendapat bahawa jawatankuasa itu harus dimodelkan mengikut garis-garis Jawatankuasa Antara Kerajaan (IGC) yang dibentuk pada tahun 1961 untuk melihat pembentukan Malaysia.

IGC yang dibubarkan pada tahun 1963, terdiri daripada wakil-wakil kerajaan United Kingdom dan Ireland Utara, Brunei, Persekutuan Tanah Melayu, Borneo Utara (kini dinamakan semula Sabah), Sarawak dan Singapura.

Menteri UK untuk Hal Ehwal Kolonial, Lord Lansdowne, adalah pengerusi jawatankuasa itu, manakala Timbalan Perdana Menteri Persekutuan Tanah Melayu, Abdul Razak merupakan timbalan pengerusi.

“Ia tidak sepatutnya jawatankuasa kabinet,” kata Abag Johari kepada waratwan selepas perasmian pameran dan persidangan air dan bahan buangan di Kuching hari ini.

Beliau juga berkata perubahan yang dicadangkan itu mesti disemak sepenuhnya.

“Saya hargai cadnagan untuk meminda perlembagaan (tetapi) lebih baik kita melihat (kepada apa yag akan dipinda) secara holistik, secara total.”

Ketua menteri memberikan Perkara 112 (D), yang menguruskan semakan geran khas untuk Sabah dan Sarawak, sebagai contoh.

Beliau berkata peruntukan itu “perlu diperkukuhkan”.

“Ia mesti seperti IGC, untuk mengkaji semua aspek perlembagaan dan juga Perjanjian Malaysia.”

Menteri di Jabatan Perdana Menteri yang bertanggungjawab ke atas hal ehwal undang-undang, Liew Vui Keong pada Isnin berkata kertas kerja berhubung jawatankuasa khas kabinet dan cadangan ahlinya akan dihantar kepada kainet untuk dibincangkan pada mesyuarat hari ini.

Liew berkata jawatankuasa itu akan dipengerusikan oleh Perdana Menteri Dr Mahathir Mohamad bersama ketua menteri Sabah dan Sarawak, Peguam Negara Tommy Thomas dan Peguam Negara bagi dua wilayah Borneo termasuk sebagai ahli.- TMI

Ak x tau la if malaya boleh mendapat rakan sekutu yg sebaik/penyabar spt sabah/sarawak..

If ikut perjanjian PDA 1974 sendiri...setiap 4 tahun..KL kena bincang blk berhubung jumlah sabah/sarawak akan dpt dari petronas ...haram x pernah dibuat oleh KL..

So far, belum lagi ak dngr sabah/sarawak klaim skali ngan tunggakan tsebut ..if dituntut..ak rasa tbogel putrjaaya tu..

Kami cuma minta hak yg spatutnya milik kami diagihkan ngan adil..tu je...

Itu pun slepas mlihat begitu jauh sabah/sarawak ketinggalan

Tp tu la..nk dijadikan cerita..bila kami ungkit psl cerita ketinggalan tu...penyokong PH akan tanya soklan...Sapa suruh sokong BN selama ni..

Bila kami blari ke BN..minta tolong talian hayat utk jwp soklan tu..penyokong BN plak..bukannya nk tolong..tp kena tibai lagi la ada....ini semua salah taib..skali ngan sorakan dari ph yg cakap ..betul2..

Ok la..skrg BN dah xada..Taib pun dah xde...kemudian bila kami sekali lagi minta...jawapan nobita....minta maaf maa...ekonomi yg tidak bagus ..ini salah kamu org sokongn Najib maaaa....pulak dah...

Kenapa x ulang blk skrip lama...kenapa sokong BN selama ni..? kenapa nak dizoom terus kat Najib...? cuba tanya balik soklan lama..kenapa sokong BN...senang kali ni kami bg jawapan...

Sebelum ini, aku rasa dah berapa kali dedahkan tentang kesombongan DAP Sarawak,  bila mereka berkuasa. Berkali-kali mereka mengugut kerajaan Sarawak. Tapi kali, aku nak dedahkan kebodohan mereka plak..Berita hari ini:


Chong told to ‘use his brain’

KUCHING: Deputy Minister of Domestic Trade and Consumer Affairs Chong Chieng Jen has been told to ‘use his brain’ before asking Sarawak government to utilise its loaded reserve of RM34 billion to repair and upgrade dilapidated schools (DS) across the state.

This advice came from Sarawak United Peoples’ Party (SUPP) Youth secretary Milton Foo who said it made no sense for Chong, who is a Sarawakian, knowing for a fact that education falls under the Federal List to offer such a proposal.

Foo stressed that it is the obligation of the federal government to provide funds for Sarawak to repair and upgrade DS in Sarawak.

“How can he (Chong) as a deputy minister utter a statement like this, having known that education is the obligation of the federal government?

“He should not push the responsibility just because Sarawak is rich in reserve and resources. It is not an excuse for the federal government,” he told a press conference here today.

Foo then gave an interesting analogy to the suggestion by Chong, who is Stampin MP and Kota Sentosa assemblyman: “It’s just like a couple, while the husband works and the wife a homemaker, the husband tells the wife, who has a lot of savings to use the savings on the family expenditure, tuition fees for the kids, electricity bills and transportation fees.”

Foo asked: “Does this make sense? Please use your brain.”
