Kontroversi terbaru, Putrajaya membelakangkan Sarawak dalam isu pemindahan Pendaftar Mahkamah Tinggi dari Kch ke KK. Sedang dalam Perlembagaan dengan jelas-Sabah/Sarawak perlu dirujuk terlebih dahulu.



KUCHING: The Office of the Registrar of the High Court in Sabah and Sarawak here will be relocated to Kota Kinabalu, effective May 1.
This was revealed in an official government letter issued by the Federal Court of Malaysia signed by Chief Registrar of the Federal Court Datuk Seri Latifah Mohd Tahar.
Copies of the letter, dated April 19 were also sent to 16 prominent relevant individuals.

In a statement issued to The Borneo Post yesterday, Batu Lintang assemblyman See Chee How said the federal government and Sarawak government must explain the rationale behind the relocation.

According to him, the principal Registry of the High Court in Sabah and Sarawak has been located in Kuching since its inception and the formation of Malaysia, with its principal functions in the administration and management of all matters relating to the judiciary and courts in the Sarawak and Sabah.

“For more than 50 years, there has never been any complaint that this principal Registry in Kuching has failed in any way to discharge its duties, obligations and functions in any manner nor failure or negligence on the part of the staffs serving in the Registry Office.



“It is also to my understanding that members of the Advocates Association of Sarawak were not formally consulted and they did not agree to the relocation of this principal Registry Office from Kuching to Kota Kinabalu,” said the Parti Keadilan Rakyat (PKR) lawmaker.

See said he was doubtful whether the Sarawak government was consulted and had given its necessary consent to the relocation.

Article 121(4) of the Federal Constitution states that ‘In determining where the principal Registry of the High Court of Sabah and Sarawak is to be, the Yang di-Pertuan Agong shall act on advice of the Prime Minister, who shall consult the Chief Ministers of the States of Sabah and Sarawak and  the Chief Judge of the High Court’, he pointed out.

“The word ‘shall’ in the provision means that the Prime Minister must consult the Chief Ministers of both States and the Chief Judge before advising the Ruler in the relocation of the Chief Registrar’s office from Kuching to Kota Kinabalu.

“But such an important decision must be made with utmost consideration given to the best interests and administration and management of the judiciary and courts, to serve justice in the two East Malaysian States and Malaysia,” he said.

However, See said he is hopeful that the Sarawak government, the Sarawak Attorney General’s Chamber and the Advocates Association of Sarawak will immediately put in a concerted effort to bring the matter to the federal government.

He added that this is to ensure that the principal Registry’s Office will remain and be maintained in Kuching.

Lawyers question shock move of High Court registry to Sabah

KUCHING: A Sarawak lawyer has questioned the motive behind the shock decision to move the registry of the High Court in Sabah and Sarawak from Kuching to Kota Kinabalu from May 1.

Calling it another “unconstitutional” move by the federal government, Dominique Ng said there were clear political motives involved.

“It could have been done to show who is the power holding sway in Putrajaya,” he said.

He added that the decision came as those in Sarawak increasingly raise concerns about Putrajaya’s motives regarding the state.


He also said the Advocates Association of Sarawak (AAS) had voiced its objections, questioning as well whether Sarawak Chief Minister Abang Johari Openg had been consulted.

The decision to move the High Court registry was revealed in an internal circular by Chief Registrar of the Federal Court Latifah Mohd Tahar on April 19, which was leaked on social media.

Another practising lawyer, Desmond Kho, said the announcement came as a “big surprise” and that enquiries with AAS revealed that there was no consultation from the Palace of Justice.

“This is an enormous decision that must have consensus from all parties concerned,” he told FMT, calling for the decision to be suspended pending a proper process.


Another lawyer, Shankar Ram, said the registry had been located in Kuching for a long time.

“Why the sudden move? Does this have something to do with Gabungan Parti Sarawak MPs abstaining from voting on the Federal Constitution (Amendment) Bill 2019?”

He, too, questioned whether Prime Minister Dr Mahathir Mohamad had obtained the consent of the chief minister, as required by the constitution.

He warned that decision could be seen as a way of eroding the rights of Sarawakians.

“What are they going to do next? Are they going to lift our immigration laws as well?”

Tapi aku berani ckp...jgn ingat mudah nak buli sarawak..

sabah kan skrg agak lemah berbanding sarawak dr segi melawan federal..of course pindah ke tempat  jrg melawan

Piasau rep to take fed govt to court over High Court Registry relocation decision


KUCHING: Piasau assemblyman Datuk Sebastian Ting is taking the federal government to court over its decision to relocate the Registry of the High Court of Sabah and Sarawak from Kuching to Kota Kinabalu, Sabah.

He said this is in view that the federal government did not consult the Sarawak government on the matter which is a breach of the Federal Constitution.

“I feel that this kind of breach must not be allowed especially when it affects Sarawak’s rights.

“If there is anything that is not helpful to Sarawak, we must bring the matter to court for them to make the decision,” he told a press conference at SUPP headquarters here today.

Ting stressed that he is bringing the issue to the High Court here in his capacity as an elected representative of Piasau and a fellow Sarawakian.

“If we don’t do anything, who knows what will happen next? So we must make sure that this must be stopped.

“Going to court is the only way to protect Sarawak’s interest and that is very important for me because it is my duty to protect Sarawak,” he emphasised.

He disclosed that he has consulted his legal team and they are looking at naming Minister in the Prime Minister’s Department (Law and Parliamentary Affairs) Datuk Liew Vui Keong as one of the defendants.

“We are looking at the federal government and the de facto law minister (Liew). We may even consider whether there is a need to include the Prime Minister (Tun Dr Mahathir Mohamad) because he was the one who advised our Agong.

“These are all inter-related starting with the (de facto) law minister and going up to the federal government itself because it is a breach of constitution. Likely, these are the three [defendants],” he said.

The relocation of the High Court of Sabah and Sarawak Registry, which will come into effect on May 1, has caused an uproar among the legal circles in Sarawak.

Kalau Putrajaya sendiri sudah tidak menghormati Perlembagaan..apa hak mereka untuk memaksa Sabh/sarawak mengiktiraf Perlembagaan ?

Ini adalah soalan kritikal untuk kewujudan Malaysia.

Kebelakangan ini, sentimen yang hampir terpendam dah bangkit semula..Perkara yang aku risaukan selama ini..

Nak aku share semua kat sini..kang x psl2 aku dicop mempromosikan Sarexit

Aku sayangkan Malaysia...tapi apa yg Putrajaya sekarang sangat menyinggungkan..Kalau Putrajaya sendiri, Perlembagaan pun mereka langgar..lagi kerat jari untuk mereka menghormati MA63.

Tanpa MA63, Malaysia tidak akan wujud.
Adakah ini SOP Putrajaya seterusnya? Cuba melaga-lagakan Sabah/Sarawak?

Kalau tgk cara Menteri Persekutuan jawap.,..mmg ada unsur-unsur nak lagakan Sabah/Sarawak..

Sabah juga berhak, bukan setakat Sarawak-mcm tu la jawapan seorang Menteri

Yang dipertikaikan bukannya siapa berhak siapa tidak...Kedua-duanya sama berhak.

Sejak 1963, Pejabat Pendaftar Mahkamah Tinggi Borneo berada di Kuching sehingga sekarang..kalau nak pindah ke KK tidak ada masalah..tp buat cara betul berdasarkan apa yang dah termaktud dalam Perlembagaan.

Kalau Sarawak tidak bantah, esok lusa apa lagi dorg buat..nampak benar melanggar Perlembagaan.

So mana pergi konsep partnership Sabah/Sarawak yang Tun laungkan sebelum ini? Setakat umpan untuk raih undi?

Mcm yang aku cakap sebelum ini, autonomi yang Tun janji nak bagi untuk Sabah/sarawak umpama raja boneka sahaja...
Rata-rata pengalisis politik dari Sarawak setuju, Putrajaya masih laparkan sumber ekonomi dari Sabah/sarawak untuk diangkut ke Malaya

Dalam kes Petronas vs Kerajaan Sarawak

Selepas keputusan yang dibuat oleh Mahkamah Persekutuan tahun lepas, sampai sekarang Petronas tidak nampak batang hitung untuk membawa kes ini ke mahkamah tinggi Borneo

Adakah pemindahan pejabat pendaftar mahkamah ini dari Kuching ke KK, adalah salah satu perancangan Tun untuk kes Petronas vs Kerajaan Sarawak?
