[Tempatan] Kes Adib: Peguam Dedah ‘Kronologi Pelik’, Niat Jahat Sembunyi Kebenaran

PEGUAM Syazlin Mansor hari ini membuat pendedahan mengejutkan mengenai wujud niat jahat pihak tertentu mengacau ganggu prosiding inkues bagi mengenal pasti punca sebenar kematian anggota bomba Muhammad Adib Mohd Kassim.

Dalam satu sidang akhbar hari ini, Syazlin menghuraikan kronologi yang dianggapnya pelik termasuk campur tangan pejabat Peguam Negara yang memberi alasan demi alasan menghalang beliau mewakili keluarga Adib dalam inkues berkenaan.

Pada permulaan sidang akhbar itu, Syazlin menarik perhatian bagaimana kes itu pada mulanya diklasifikasikan sebagai kes bunuh, namun tiada perbicaraan dijalankan, sebaliknya Peguam Negara, Tommy Thomas mengarahkan diadakan prosiding inkues.

Kronologi perjalanan inkues itu kata Syazlin juga pelik apabila beliau diarahkan menarik diri selepas mula menyoal teori pakar patologi Hospital Kuala Lumpur dan membawa Perunding Kanan Patalogi Forensik di United Kingdom, Prof Dr Shahrom Abd Wahid untuk memberi keterangan.

Untuk rekod, keterangan Prof Dr Shahrom bertentangan dengan keterangan pakar patologi Hospital Kuala Lumpur berhubung cara Muhammad Adib meninggal dunia.

“Saya merasakan adalah pelik kerana apabila saya mula menyoal teori pakar pakar patologi Hospital Kuala Lumpur dan membawa Perunding Kanan Patalogi Forensik di United Kingdom, Prof Dr Shahrom Abd Wahid untuk memberi keterangan, barulah isu konflik pelantikan saya dibangkitkan.

“Walhal menjadi kewajipan dan tanggungjawab saya mewakili pihak berkepentingan untuk berbuat demikian dengan niat mendapatkan kebenaran atau membuat dapatan apakah yang paling mungkin boleh berlaku kepada arwah Adib yang membawa kepada kematiannya,” katanya.

Sidang media khas itu turut disertai Persatuan Peguam-Peguam Muslim Malaysia termasuk Presidennya, Datuk Zainul Rijal Abu Bakar.

Muhammad Adib, 24, cedera parah dalam rusuhan Kuil Sri Maha Mariamman, USJ 25, Subang Jaya pada 27 November tahun lalu dan meninggal dunia pada 17 Disember lalu di Institut Jantung Negara selepas 21 hari dirawat.

Prosiding inkues itu berlangsung di hadapan Koroner Rofiah Mohamad memasuki hari ke-36 dan 29 saksi telah dipanggil memberi keterangan.

Dalam prosiding sebelum ini, keterangan saksi pakar Dr Shahrom adalah bahawa kecederaan Muhammad Adib berpunca daripada beliau ditarik dari van Perkhidmatan Penyelamat Perubatan Kecemasan (EMRS) dan diserang.

Keterangan itu bercanggah dengan keterangan saksi pakar yang dikemukakan oleh timbalan pendakwa raya, iaitu Dr Ahmad Hafizam Hasmi dan Dr Mohd Shah Mahmood yang berkata kecederaan Muhammad Adib bukan berpunca daripada beliau ditarik dari van EMRS dan diserang.

Syazlin Mansor melahirkan rasa hairan mengapa Tommy mempersoalkan ‘tugasnya’ dalam inkues siasatan punca kematian Muhammad Adib selepas beberapa bulan prosiding itu sudah dijalankan.

Beliau berkata alasan yang dikemukakan oleh Tommy Thomas bahawa beliau tidak membantu siasatan inkues apabila sering bercanggah dengan pendakwa (pegawai pengendali inkues) juga tidak boleh diterima.

Syazlin yang mewakili Kementerian Perumahan dan Kerajaan Tempatan, Jabatan Bomba dan Penyelamatan serta keluarga Adib secara pro bono (tanpa bayaran) berkata, selepas akur kepada arahan menarik diri daripada inkues beliau telah bertanya kepada Pegawai Pengendali Inkues, Faten Hadni yang juga Timbalan Pendakwa Raya kes tersebut.

Malah, Syazlin mendedahkan bahawa beliau ada bertanya sendiri kepada Faten berhubung perkara tersebut dan terkejut dengan respon yang diterimanya.

“Pada 27 Mei iaitu tarikh saya menarik diri, saya ada bertanya kepada Faten. Mengapa baru sekarang peguam negara mempersoalkan pelantikan saya. Bukankah dari awal lagi peguam negara maklum saya mewakili mereka.

“Beliau berkata memang benar Peguam Negara maklum tentang peranan saya dari awal , tetapi beliau tidak membuat sebarang bantahan kerana berpendapat saya akan bantu inkues dan bertindak secara bona fide (niat baik).

“Saya kemudian mempersoalkan bila masa pula peguam negara berpendapat saya tidak membantu inkues dan bertindak secara mala fide (berniat jahat)?

“Beliau menjawab, apabila saya bercanggah dengan kedudukan yang diambil pegawai pengendali inkues dan mempersoalkan teori pakar HKL,” katanya.

Tambahnya cubaan Tommy mengaitkan kedudukan suaminya Ahmad Soffian Mohd Shariff yang juga Setiausaha Akhbar Menteri KPKT adalah berniat jahat.

“Adakah salah bagi saya seorang peguam yang ingin membantu keluarga mangsa secara pro bono? Saya percaya ia tindakan jahat untuk memburukkan nama kami,” katanya.

mohon bantu ye. biar kebenaran terbuka. sebab kes ni melibatkan kematian pegawai bomba. kita wajib ambil cakna.

kenapa sebarkan kepada orang melayu? sebab kes ni pelik ada yang cuba ganggu. orang melayu wajib bersatu.

kita ikut saluran undang2 untuk tegakkan kebenaran bagi arwah adib

Betul sy sokong.. Kes ni dah terang lagi besuluh. Nampak sgt kes ni bias dan RACIST. Tiap kali pun ada je statement bercanggah.. wtf la.. Byk sgt dah sogoknye. Wlupon masuk 7 bulan org tak akan lupa. Tu anak org kot kena tibai ramai2. Lipas tu kau hempap byk kali wlupon masih gerak2 lepas berapa jam mati juga. Itu la ibaratnya.. Semoga kebenaran cepat terbuka n semoga peguam yg mewakili arwah tak putus asa merungkai kebenarannya..

lepas ni kesatuan2 kaka akan racist kat budak2 kellyng ni. tunggu tukar kerajaan kita kasi kukuhkan orang melayu.. mereka racist tak ngaku, melayu racist kena hina. no way .. kita racist suka hati kita lah? ada mereka nak hormat kita? hormat perlembagaan?

kes terowong pun senyap xpelik pun. malaysia baru tobby.

1mdb alhamdulillah kes berjalan moga najib kena hukum kalau bersalah, kalau tak bersalah moga ds najib saman semua terlibat. moga kes lain berjalan dan didakwa

tak macam kes pakatan harapan senyap begitu je. ini lah malaysia baru.

byk sgt tangan2 ghaib campur tangan sejak awal inkues.  rule of law Malaysia Baru. yg jd banduan kes liwat pun boleh diampunkan. kes banglow tak tunggu bicara terus digugurkan dgn campur tangan langsung AG.

ramai yg belum dengar press conference oleh peguam Syazlin ni...  kena sebarkan seluas mungkin.  klu dah dengar baru tahu cerita sebenar. keluarga Adib pun pertikai kenapa AG mesti campur tangan

Justice and Truth Must Prevail in the Inquest into the Demise of Firefighter Muhammad Adib Mohd Kassim

The Malaysian Bar is disconcerted with recent events in the ongoing inquest into the death of the firefighter, the late Muhammad Adib Mohd Kassim (“Muhammad Adib”), in relation to the withdrawal of the advocate and solicitor, Syazlin Mansor, from further representing the Ministry of Housing and Local Government (“Housing Ministry”), the Fire and Rescue Department (“Fire Department”) as well as Muhammad Adib’s family, and the reactions arising therefrom.

An inquest is a legal proceeding comprising an inquisitorial and investigative process — not a criminal trial — where a Coroner inquires into the circumstances surrounding a death, and whether any person is criminally concerned in the cause of the death.

It has now become apparent that Syazlin Mansor was appointed directly by the Housing Ministry and the Fire Department to represent them, when lawfully it is an officer from the Attorney General’s Chambers who should appear for the Government and its agencies, unless the Attorney General gives an advocate and solicitor a fiat to appear for the Government pursuant to the Government Proceedings Act 1956.  No such fiat was issued to Syazlin Mansor for her appointment, and hence she should not have been appointed as legal counsel by those Government agencies.

In his media release dated 28 May 2019, the Attorney General also raised the point that Syazlin Mansor “was in a conflict of interest position when she agreed to act for the Housing Ministry and the Fire Department as she was also acting for the deceased’s family, who have a direct interest in the Inquest”.

Indeed, it is indisputable that advocates and solicitors hold fiduciary and/or contractual duties towards their clients.  It is therefore the obligation of every advocate and solicitor to scrupulously guard against, and avoid, situations of conflict of interest — both actual and potential — particularly in representing multiple parties.  The seemingly common interest of various parties being represented by a single advocate and solicitor could potentially result in divergent or competing interests, and thus impair the ability of the advocate and solicitor to act in the best interest of the parties concerned.

One example is if, in the aftermath of the inquest, Muhammad Adib’s family files a civil suit against the Government.  As another example, if the inquest determines that the Government was responsible for Muhammad Adib’s death, the firefighter’s family has the right to commence legal action against the Government.  In both these situations, the evidence that had been tendered and led by Syazlin Mansor during the inquest — ie when she was simultaneously representing the Government and the family — could then be used during the subsequent legal proceedings, hence resulting in a clear case of conflict, as the various parties would then have opposing interests.

The prohibition against advocates and solicitors acting in a position of conflict is stipulated in the Legal Profession Act 1976, the Legal Profession (Practice & Etiquette) Rules 1978, and the Rules and Rulings of Bar Council Malaysia — for example, where the acceptance of a brief would render it difficult for an advocate and solicitor to “maintain [his/her] professional independence” or if it is “incompatible with the best interest of the administration of justice”.  In determining whether there is conflict, the objective test to be applied is not whether there is actual conflict, but whether there is an appearance of conflict.

In Teoh Meng Kee v Public Prosecutor [2014] 5 MLJ 741, the Court of Appeal held as follows:

An inquiry of death is not like a criminal trial. . . . It is only an inquiry by a magistrate as to the cause of death and the deputy public prosecutor is there not to prosecute anyone but only to assist the court with the examination of witnesses for the purpose of receiving the evidence. . . . Counsel present is there not to defend anyone but only to look after the interest of those who have appointed him. . . . [emphasis added]

In light of the above, the Malaysian Bar is of the view that Syazlin Mansor should have therefore declined to act simultaneously for the Housing Ministry, the Fire Department and Muhammad Adib’s family.  While an inquest is not a trial and is only inquisitorial in nature, the strong public reaction to this is itself illustrative that, in the public eye, there is an appearance of conflict of interest.

It is highly regrettable that no objections were raised at an earlier stage of the inquest proceedings, either by the Coroner or the Conducting Officer, once Syazlin Mansor was on record for the parties concerned.  The instructions for her to withdraw as counsel at an advanced stage in the inquest may have contributed to a negative perception by the public regarding the turn of events.

The unfavourable perception is further exacerbated by the earlier act of the Deputy Public Prosecutor in filing an affidavit that reportedly stated that the death of Muhammad Adib was not due to beatings by any person, when any findings relating to cause of death are in fact exclusively the prerogative of the Coroner in an inquest.

All parties concerned should have adopted a more prudent and cautious approach from the outset.  The failure to do so has led to unnecessary speculation and adverse perceptions.

Be that as it may, once an advocate and solicitor’s position in a matter becomes untenable — at any stage of the proceedings — due to a conflict of interest, he/she must discontinue from acting for parties with divergent or competing interests.  As such, the Attorney General’s action in revoking Syazlin Mansor’s continued representation of the Housing Ministry and the Fire Department was a step to resolve the conflict of interest and preserve the integrity of the ongoing inquest.

As the chief legal adviser to the Government, the Attorney General is entitled to take this position, which must not be construed as muzzling any particular or opposing view regarding the events leading to Muhammad Adib’s demise.  It is noteworthy that the Attorney General in no way precluded Syazlin Mansor from continuing to represent Muhammad Adib’s family in the inquest; she withdrew from doing so, of her own accord.

Syazlin Mansor’s withdrawal as legal counsel in no way invalidates or diminishes the evidence that has been adduced thus far, as all such evidence will remain on record.

Every Member of the Bar is urged to be vigilant and circumspect, and to examine, on a case-by-case basis, whether he/she would be “embarrassed”, or if his/her professional conduct is likely to be called into question, if a brief is accepted.  This is a duty that all advocates and solicitors must take seriously.

It is crucial that these recent developments not be permitted to detract from the ultimate objective of the inquest — to shed light on the circumstances surrounding Muhammad Adib’s tragic death and to bring those responsible to book.  The Malaysian Bar calls on all parties in the case to do their utmost to ensure that not only is justice done, but that it is also seen to be done.  Truth and justice must prevail.

Tak ada auntie Kabu.... Dia ni presidin Majlis Peguam Malaysia yang baru di lantik..... Rasanya belum sempat Presidin baru itu buat suggestion kat AG supaya hantar memo kat semua Menteri menteri bahawa kalau ada Kementerian nak pakai loyar kalu, sila telpon AG Chambers dan bertanya cara nya. Tolong jangan tanya kita punya pembantu menteri, " Lu ada bini kerja loyar ka? Tolong suroh dia datang ofis ambik surat perlantikan. Kita nak engage dia!"

Kekadang walaupon menteri ni grad dari NUS, dia tak berapa cerdik. Mungkin masuk NUS pon pakai quota bumiputera.....Prrrrrrrrrpffftght

thank you, the statement is very clear and precise. I, however, fear that many may still misunderstand and still accuse of the AGC playing the race card.
