13 years jail for soldier who raped friend's wife

A soldier was today sentenced to 13 years’ jail and six strokes of the cane by the Ampang Sessions Court which found him guilty of raping a friend’s wife during a sleepover at the couple’s home.
Judge Syafeera Mohd Said handed down the sentence on Corporal Mohd Zulkarnain Abdul Razak, 37, after finding that the prosecution had succeeded in establishing the case without reasonable doubt at the end of the defence case.
She ordered Mohd Zulkarnain to serve the jail sentence from today.
In mitigation, lawyer Mohd Azhar Mohd Ghazali, representing the soldier, said his client had been with the armed forces for 18 years.
The prosecution was conducted by deputy public prosecutor M Arunjothy.
On July 22 last year, Mohd Zulkarnain pleaded not guilty to the charge of raping the woman.
He was charged with raping the woman, aged 25 years and 10 months, in the victim’s bedroom at an apartment here at 3.30am on July 12, 2016.
The charge, under Section 376 (1) of the Penal Code, provides an imprisonment for up to 20 years and is liable to whipping, upon conviction.
According to the facts of the case, the victim was sleeping with her child when the accused entered the room and raped her in the dark.
She realised that the man was not her husband when she opened her eyes.
The woman’s husband was not at home then.

A Malaysian Soldier Who Raped His Friend's Wife Has Been Sentenced To 13 Years In Jail
The army corporal will also be whipped six times.
Corporal Mohd Zulkarnain Abdul Razak, who in July 2016 was charged with raping a 25-year-old woman, was sentenced to 13 years in jail and six strokes of the cane yesterday, 14 December
According to a Bernama report published on NST Online, Judge Syafeera Mohd Said at the Ampang Sessions Court found the 37-year-old army corporal guilty of the charge.
He had committed the offence at a flat in Hulu Langat, Ampang, where he raped his friend's wife during a sleep-over at the couple's home at around 3.30am on 12 July.
Corporal Mohd Zulkarnain Abdul Razak, however, had pleaded not guilty to the offence after the charge was read to him on 21 July last year in the Sessions Court.
The victim was said to be sleeping with her child when the army corporal entered the couple's bedroom and raped her in the dark
She realised that the man was not her husband when she opened her eyes.
According to the facts of the case, the army corporal's friend, the woman's husband, was not at the home at the time of the incident.
The army corporal, who had been with the armed forces for 18 years, was ordered to serve the jail sentence from Thursday
He was charged under Section 376 (1) of the Penal Code for rape.
Following which, the prosecution had succeeded in establishing the case without a reasonable doubt at the end of the defence case, Bernama reported.
While the charge under the said section carries a maximum 20 years' jail, Judge Syafeera awarded Mohd Zulkarnain 13 years in prison.

Satu i tak puas hati. sebab masa coversation di kedai makan tu hari :
a) dia kata nak pindah rumah. cut cost . cari bawah RM 1000 - i am ok
b) Dia tak bagitau dia nak buat anak ke 2.
dia dah broke calculation yang i dah buat. Dia pergi pindah rumah yang RM 1k lebih
last bulan febuari tu hari bini dia bersalin.
