itu hak kita. kita bayar utk dapat umah n barang2 yg kualitinya seperti yang tercatat dalam S&P dan barang2 / fit outs yang disertakan mestilah dalam keadaan baik n berfungsi dengan sepatutnya..

Saya bercadang utk menahan bayaran 5% yg still ada utk cari kontraktor sendiri, nak repair segala defects yg tak dibuat oleh developer. Dah 5 kali inspect dan report defects meaning nearly half year tunggu. Sape boleh tunggu/sabar lagi???

I have been very mild with them.

Ada tak sesape kat sini yg pernah buat benda nih? Please share with me, really appreciate it.

Yang pasti bila saya call developer, dan cakap pasal nak tahan payment tuh...banyak cerita pulak dari diorang...yg bagus tuh 'kebetulan' yg ambik 5th report defects saya boleh cuti seminggu..dan exec. yg deal this sort of things..pegi umrah katanya.

Sedih dan pening kepala tau bila pikir pasal rumah baru saya tuh. Bila kita report defects mcm aluminium frame yg teruk tuh..bila dtg after one month..diorang boleh spray dgn cat!!! Sah2 boleh nampak dan senang bercalar. Tak usah saya citer pasal benda lain.

Memang diorang touch up ajek sume.  Saya malas nak listkan kat sini benda2 yg tak sedap mata memandang dan yang merisaukan saya sebabnya karang ada yang sedap2 ajek nak mengata kononnya cerewet tak bertempat!

Gamaknya kalau diorang (staff kontraktor) tuhler dapat rumah dengan segala macam masalah...dia suka tak???

tulis surat to ur S&p lawyer, mintak dia withold the last 5% payment to developer n cc surat tu ke developer. sertakan sekali defect list tu n kalo boleh dapatkan inwriting reply dr developer tuh. kita boleh withold 5% yg last tu... contact ur S&P lawyer....

    ini biasa org buat, esp yg ade experience in buying. tulis surat to ur S&P lawyer, mintak dia hold that last 5% n jgn lupa cc to developer... sure lepas ni laju jer.. developer ni kalo dengar payment withold, baru mencicit cicit nak buat keje.....

    saya nk confirmation...kalau let say developer dah hantar yg claim 5% tu kat bank, pastu kita minta hold dulu payment, then bank ikut kita punye arahan, adakah kita as buyer akan kena tanggung interest for late payment?
sesiapa tlg explain?

    the last 5% tu developer hanya boleh claim setelah tamat DLP, defect liability period. sekarang DLP = 2 tahun. lepas 1 tahun dr serah kunci, developer bleh claim half i.e. 2.5% n balance lg 2.5% tuh bila habis DLP... kalo xder complaint dr buyer... so better get all ur complaints.. n kalo nak lebey lanjut, pick up u phone, n call ur S&P lawyer... u bayar the fee is not for nothing.... utk lawyer2 tu buat this kinda worklah... untul enforce the terms n conditions tht both of u  ( buyer n developer ) had agreed.......

u tak boleh arah bank... u bg arahan to ur lawyer, with the documents as ur backup of course.... n then u r lawyer supposed to askd the developer lah. as all is stataed in the S&P.... baru lawyer akan advise bank to hold the remainder... kalo u bising2 kat sini, bising2 kat opis developer takde maknanya... kite pelu tau nak bising kat mana... or else jadi anjing menyalak bukit.... kene tau kat mana nak bising.... n jalan terkahir we as buyers always have Tribunal Pengguna n Kementerian Perumahan Kerajaan Tempatan (KPKT)... jadilah pengguna / pembeli rumah yang bijak.

sebab tu saya bertanya, so that saya dapat info & tahu nak channelkan ke mana...
kalau saya dah tahu, takde la saya bertanya lagi...
u yg dah biasa ngan construction field, tahu la apa nk buat...
cam saya ni mana tahu semua tu...that's why saya nak tuntut ilmu kat sini...
kdg2 kita as lay man ni tatau bila masa nk refer to lawyer...kdg2 lost...bila refer to Tribunal pun masa tu nasi dah jadi bubur...

    mula2 u list all the defects, preferably in writing n photos sekali.. then bagi as 1st report to the developer n cc sekali to ur lawyer.
every communication to the developer, u cc sekali to ur lawyer.
kalo smpi 3 kali dia buat derk jer n after u refer to lawyer, u fwdkan all the list to KPKT.

Last week developer call and tanya kenapa dan apa hal, maybe baru nak terkial- kial take the matter seriously! Kalau tidak buat tak tahu dan buat tak faham-faham.

Hubby beri chance another 2 weeks for them to rectify everything.

Ahad saya pergi tengok rumah. Nampaklah ada barang- barang diorang kat ruang tamu. Baru nampak macam buat kerja!

Pintu takde lagi...door knob cabuk ada lagi ( saya bukak pintu dapur terus terkeluar benda alah yang kita masukkan kunci tuh, terkejut saya!)

Saya tak yakin akan rasa berpuas hati nanti, so saya akan standbykan untuk developer my 'love letter' hahaha. I'll pass it by hand.

UNTUK MEREKA2 YG TERLIBAT DALAM HAL2 MACAMNI TOLONGLAH JANGAN BUAT SAMBIL LEWA BUKAN SEMUA ORANG BODOH DAN BUKAN SEMUA ORANG BOLEH DIPERLEKEHKAN!

    berapa kali kita boleh submit defects complaint ni yer? cth kalau kita submit dlm masa 2 mgu lepas dpt kunci... pastu ada pulak defects lain kita jumpa ... kita nak submit defects complaint ke2 tu ada sekatan apa2 tak?

i ada 2 thn DLP... yg nak complaint skrg ni, yg awal2 jumpa ni dulu.

    selagi tempoh DLP tu masih berjalan, u boleh kasi defect list. hatta 100 kali pong...
tp list tu yg developer / contractor punya salah la....

Yup ...hantar banyak2 kali pun takpe...selagi tak puas hati tuh ...sampai dah puas hati macam saya nih.

Dah ugut baru nak buat...I am not sure either developer ngan contractor tuh friend-friend or whatever!

Awal sume macam takde apa2 tapi kata dah marah2 kat contractor apa sume...benda takde repair apa2 pun.

Last2 kitorang ugut to take the matter upstairs baru ler jalan sume.

What happened is they will ask you to wait for one month for them to do the repair work...so sebelum kena tunggu tuh better list kan sekali yang tak puas hati dulu..mana yang tak perasan tuh kalau dah terperasan call diorang bagitau.  Kotler diorang boleh repair sekali harung.

Kalau tak bernasib baik kena  bersabar banyak2 ler...macam saya setengah tahun kena tunggu hahaha.

ekceli saya ni tgh tak kompiden sket.. sbb lawyer tu lawyer developer 'punya' (dah termasuk dlm harga rumah la tu... plus mark-up sekali la, of course)

tapi saya tetap ikut prosedur yg orang cakap kat byk2 forum... to file the complaint in writing...

Alhamdulillah sebaik saja developer dpt tau, (developer kecik la relatively), anak tokey tu marketing manager & pernah pinjam duit dgn saya pun (boleh camtu?)

Dorang terus dtg tgk kat mana yg defective tu... the next day terus dtg bawak org repair.

Major defects la, saya kira, sbb ada bocor2... pintu bilik ke3 tu kunci takleh guna (tersilap bagi kunci saya kira)...

Kemudian yg kecik2 tu, mcm excess cements, plaster tak licin kat windowsill, 'cap tangan' kat dinding, dorang terus repair on the spot.

Yg ukuran rumah, OK, sama mcm plan... mozek kemas la..takde senget2 & bunyi padu bila diketuk.
