Problem Dgn Process Pembelian Rumah & Housing Loan

Salam Forumers,

Aku ade masalah berkenaan dgn pembelian rumah.
OK. aku crita dr awal pembabitan aku dlm beli rumah ni yer. Aku beli rumah 2nd hand since Sept 2009 (low cost - S & P signed since sept 2009 jgk) pd harga 85K. Aku pun da apply loan Bank and Offer letter approve by 85% from the house value (time ni aku da happy igt da settle ).

Disbbkan S & P lawyer aku sengal and lembap, process pembelian da kena delay plus owner lame rumah tu x bayar beberapa charges and also maintanance fee, bertambah la delay process pembelian rumah (aku da bayakan sume tolak duit deposit another 5% yg mase tu aku belum kuarkan EPF sbb x dpt facility agreement sbb housing loan aku da lebih tempoh setahun).

Oklah menda2 yg aku sebut kat atas tu sume da settle baru2 ni dlm bulan April 2012, tp another masalah timbul bile disburstment housing loan aku x lepas sbb offer letter loan da melebihi 2years++.
Aku pun call la bank tu and ckp ngn Disburstment officer, katenye disburstment hanya bole release lepas da dpt approval for "extend availabily" utk offer letter loan aku yg sblm nih, dorg kate kena call branch yg aku deal sblm ni utk mintak expedite process baya balik pada owner rumah aku skg ni la kan.

So, Hari-hari aku duk call Branch yg kuarkan offer letter tu tnye status tp sampai lah ke hari ni dorg kate masih tunggu approval.

Masalah aku :-
1. Ape sebenarnye process housing loan kalau offer letter dah melebihi 2years++ ni??
2. Perlu ke aku carik bank lain utk re-process loan aku sbb skg nih sume dokumentation da lengkap, tgal bank release duit je.
3. td Owner rumah call aku, die kate redemption statement bank die nk expired 30/06/2012 and die mintak aku percepatkan process belian rumah sbb die kate die nk jgk duit balance yg sepatutnye die akan dpt pd bulan ni.
3. Owner rumah threaten aku, katenye die xnak renew redemption statement lg klau da expired, die nk jual rumah die ni pada org lain?? Bole ke die wat aku cmtu kat aku??cemane ngn duit deposit aku sblm ni & charges S & P yg aku da baya sblm ni??

Mintak tolong forumers yg pernah ade masalah mcm aku ni, and advice ape patut aku buat, sbbnye.
Deposit 13K aku da baya pada owner lame and S & P lawyer charges aku pun, aku da abes bayar.

siannya jadik camni..

patutnya S&P loyer tu menyenangkan proses.. ini jadik penyebab pulak.

ai taktau nak tolong la TT, cuma harap bersabar & moga2 u dpt jugak beli rumah tu nanti.

kalau tak dpt jugak, mungkin ada rezeki lain nanti...

Tu la..Housing Loan Alliance Bank... mmg lame sgt da offer letter tu..masalahnye sume xnk tolerate ngn aku..1. Alliance Bank -  x bgtaw keputusan samada bole continue guna service die ke hape, sbb "extend availability" x sure bape lame bole approve. haih...
2. Owner rumah skg - x sabar2 lg..sbb skg ni bkn masalah salla kat aku..kebetulan loan aku stuck cmtu..aku tgh tgu proses terakhor aje ni iaitu release duit pd penjual..tp nth la..rezki aku nk kena cm ni..
3. Lawyer S & P - aku tgh push supaya dorg push lawyer bank. tp x sure la cemane deal nye..

Seriusly..aku rase fedup sgt..nk nangis pun ade..hati x tenang, mesti mlm ni aku xleh tido..

ko kena refer balik clauses dlm s&p tu. mcm aku punya dia include kalau memorandum / consent of transfer tu rejected bukan sbb kesalahan owner atau buyer, owner kena refund duit kpd buyer. kalau salah owner, refund plus compensation.

kalau owner jual rumah tu kat org lain, kira breach of s&p ke? kalau ye, ko berhak dpt balik duit2 ko.

yg bab validity s&p tu aku x sure, so xleh nak tolong. tapi aku punya haritu sangkut lama sbb nak dpt approval dr land office, yg consent tulah. tapi once dah dpt approval, laju je bank release. pelik pulak kalau sangkutnya kat bank...

apa2 pun, aku rasa better ko deal dgn lawyer tu. kita dah lantik dia, mana leh lepas tangan. ko ada bgtau x pasal owner nak jual kat org lain tu? heh lawyer aku dulu pun melayu, ok jek. cuma kena rajin follow up la. kawan aku amik lawyer bangsa lain, siap gaduh2 kat tepon lagi, pastu kasik alasan lambat sbb x jumpa dokumen.

why not ko g resubmit kt bank len plak..?kalo jual beli rumah ni jgn depends kt satu bank jer....kena antar kt sume bank.utk cepatkn proses..slagi drg x ckp bile approve toksah percaya sgt lah...ermm kalo ko nk contact bank yg insyaallah leh approve..nnti ko pm aku...kalo nk laa...kalo xnk xper..huhuhu

ko refer balik ngn lawyer...sbb dia yg bertanggungjwb nk settle benda alah ni sume...push je dorg...ckp lah ko nk g obersea nk settle segera...create urgency sket...

ni last resort..ko dah submit mane2 x lepas ko try wat MBSB..tp interest sgt tinggi & sedikit lembab compared to bank'

bank - 1 week dah dpt result
MBSB - 3 week terkial2 bg result

skrg BLR 6.6 depends laa kat bank mane mintak....

jgn pm aku tnye mcm2 soklan lak..ni info pon sbb aku ejen hartanah part time...so mmg kena taw lobang2 nk loan rumah..huhuhu

ooo..mcm tu yer?? aku akn check blk S & P lawyer clause2 yg termaktub dlm tu..tu la aku pening..patutnye bile sume da selesai and sepatutnye cecpt dorg release duit kasi kat vendor..ini x, lame gile nk check approval nye..dr bln April.Kalau da expired and xleh guna lagi service dorg..patutnye inform la aku awl2..spy x jd delay mcm ni..
Xde la..org kate sblm kite nk hire lawyer, better tgk background ape yg dorg terrer. Mase aku follow up dlu, lawyer suh check ngn staff die aje..die slalu ke court, pastu die the only lawyer yg ade kat sana.

Pekerja die yg aku deal pun da masuk ke-4, sbb yg sblm2 ni yg handle case aku ni sume da benti, aku xtaw la sbb ape..yg ke-4 ni ok sket..tp tu la..bile da abeh settle sume documentation, Loan bank plak sangkut..pastu kena ugut ngn tuan rumah plak klu dorg x dpt payment bln ni..nk terminate S & P.

So, pada pandangan ko lah, masalah ni berpunca dr aku ker? aku ke yg salla weyh?? risau gak aku, aku da follow up ngn bank ari2 dah ni..sakit otak aku bile budak bank kate masih tgu approval.

Kalau aku re-submit pd bank lain, cemane dgn Loan lawyer yg aku da deal sblm ni iaitu panel pada Alliance bank ni??Sbbnye, aku da signed sume documentation Jual Beli rumah dgn Alliance bank and dokumen sume da stamping, cume duit x lepas (perlu approval which aku x sure nk tgu bape lame)..aku risau, pas aku carik loan lain, aku ade prob ngn bank ni plak..
kang die saman aku kate aku da sign sume tp aku p deal ngn bank lain....ke cemane pendapat ko?? atw ko bole tlg tnye kan ape akibat dgn aku berbuat cmni??

   selalu aku deal sub sale...xde free lawyer...buyer bayor sundirik...
  ini mcm cerita....ko tnye lawyer tuh dulu...discuss baik2 sbb ko dah bayar everything...let says ko tunggu dorg...x tentu bile approved nyer...time is money kata kt dorg....dorg pon mungkin leh kompromi sbb tgk status bank yg merepek camtuh...dah bertahun weh...kalo aku nanges berbaldi dah...

since ko kena push lawyer utk settle problem nih...pasal ko ckp dia panel...kena ikut procedure kena la tunggu alliance camtu...tp tgk keadaan bank sendu yahamat camtuh..maybe lawyer akan suggest ko carik bank lain...dia pon nk case close cepat gak...dia pon nk duit gak...

so summarized , ko discuss ngn lawyer...push their to settle...sbb benda ni dorg yg mendelaykn bukan ko...ko create urgency nk settle cepat...seller pon x koser nk tunggu camni...tp dia xleh cancel sbb dah sign snp kecuali ade sebab kukuh....tp suppose kena settle 3+1 mths balance loan dah settle...tp dah berlarutan cmni...so how? ko tnye kt dia...push seboleh2 nyer...xpon ko ckp je nk saman nk tuntut ganti rugi dah susahkn ko dgn lmbtkn proses loan...
(ko tipu je laa acah dorg..bukan suruh betoi2 g saman)

Hmm..esk la aku cube goreng2 kan lawyer tu..tp masalah skg..lawyer2 da abeh kje da..Loan lawyer pun kate die da follow up ngn Bank utk release duit..Now, proses stuck kat Bank which dorg tgal nk lulluskan pay check kuar aje..haih la badan...

xpe la..esk aku try talk ngn lawyer S & P and Lawyer Bank, plus branch yg kuarkan offer letter tu.. Klu Owner nk wat cmtu, aku nk wat cemane pun kan..cume aku kena tuntut deposit 13k aku blk n maybe xde rezki aku nk duk uma tu la...

   wah..senang nyer keje dorg...lawyer nyer keje yg byk compared ngn banker ngn real estate negotiator...dia kena wat a to z...cam nk lepas tgn je bunyik nyer....ko check balik s n p ko..ape klausa2 dia...selalu nyer sub sale 6 mth dh settle....ko kena push dorg smpi settle...mcm si awan kelabu ckp tuh...ko leh dpt duit balik...walaupon dah sign s&p....sbb ko xsalah
tabahkn ati weh...insyaallah kalo rezeki x kemana...

aku pun x sure sapa benar sapa salah. dah jadi, nak buat camne kan.

aku dulu pun kalau call ke sms dgn clerk, bila email baru direct ke lawyer. tapi tiap2 bulan la aku email tanya status nasib la dua2 ok. hmm seingat aku, dulu kalau diorg ckp tgh tunggu lagi, aku tanya tunggu apa. kalau dia kata bank, aku call org bank yg uruskan loan aku. kalau dia kata owner, aku email owner tu (hehe pushy x aku )

tapi i strongly suggest ko contact lawyer ko tu

mane la taw aku kena slow talk ngn seller tanye solution lain ker...ataw die nk revised harga ke klau aku still nk rumah tu..
al-maklum la kan..2 tahun lepas harga 85k..now mgkn da naik 100K, ralat kot owner tu tgu lame sgt..huhu
