[Aduan] Jual rumah-masih x dapat balance

Saya ada jual rumah.. skrg ni masih x dapat baki..sy nak minta sesiapa yg arif dalam hal ni utk explainkan pada saya berkenaan dengan klausa ni..klausa ni ada dlm snp

"The balance of thePurchase Price amounting to RINGGITMALAYSIA FOUR HUNDRED SIXTY EIGHT THOUSAND (RM468,000.00)only (hereinafter referred to as “theBalance Purchase Price”) shall be paid by thePurchaser to the Purchaser’s Solicitors as stakeholders within three (3)months from the date of this agreement (the last day of the three (3) months period shall hereinafter bereferred to as “the Completion Date”), failing which the Vendor shall grant tothe Purchaser an extension of one (1) month (the last day of the one (1) monthperiod shall hereinafter be referred to as “the Extended Completion Date”) topay the Balance Purchase Price in which event the Purchaser shall pay to theVendor an agreed interest on the unpaid balance at the rate of eight per centum(8%) per annum to be calculated on daily basis from the expiry of theCompletion Date to the date of payment PROVIDED ALWAYS THAT any delay exceeding fourteen (14) days fromthe date of receipt of written request by the Vendor or the Chargee in givingany undertaking or document which is incumbent upon the Vendor or the Chargeeto give to complete or facilitate the completion of this Agreement shall beexcluded from the computation of the Completion Date or the Extended CompletionDate, as the case may be and no late payment interest shall be imposedon such delay."

Saya nak minta tolong sesiapa yang arif utk bg penjelasan..

apa tarikh s&p? dah lepas 3 bulan ke blm. 3 bulan jugak x bermakna cukup2 tarikh s&p. kene tolak jugak tunggu redemption staten=ment. dokumen balik dai bank. macam2 lagi. boleh tanya loyer nape x dpt balance lg. dia org mesti ada explanation.

snp sign 21 July. 3 bulan tu on 22 Oct..extended tu pd 22 Nov. skrg ni lawyer kata delay tu sbb lambat dr financier sy. sy guna loan gomen. tp actually, lawyer yg tak buat keja, diorang x follow up. ms utk dptkan redemption statement pun lambat sbb x follow up, last2 sy yg ke BPP ambik dan bg pd lawyer. then utk ms lawyer request gomen utk release geran tu pun sama, Documents dah siap 20th nov, tp tak de siapa follow up, last2 sy ke BPP, dan check, dan inform lawyer..

Skrg ni, they claimed that semua tu punca dr sy dan BPP, so that yg 8% tu tak terpakai. Skrg ni lawyer dalam proses utk tukar title, then settled yg tu br blh release payment.

saya nak tau pasal statement kat atas tu.sy blh claim ke yg 8% tu?

Adik i dulu pon dapat lambat..
I call hari2 lawyer office tanya.
Bila hari2 i call they pun push buyer..bila dapat balance payment adik i bagi i rm500..

kalau nak claim 8% tu, kene buat kronologi. kene tengok tarikh surat2 dan redemption semua. betul ke loyer yg lambat atau memang bpp lambat. dulu2 bpp memang lambat. sekarang x kot.

Bank buyer issued balance payment pd bpp pd 23hb nov, bila sy call bpp pd 27hb, katanya cek dah settled.dan semua urusan di bpp settle pd 20 nov.saya ke bpp dan cek pd 1 dec, staf yg jaga tu explain status file sy.in between lawyer x de buat follow up pun dgn bpp.in fact, ms buyer bising2 pd 30hb tu, lawyer hantar lg 1 surat pd bpp, wp sbnrnya dah setel.nampak sgt diorang x follow up.

Sblm ni pun, ms bg statement utk bank buyer buat balance payment pd bpp pun ambil masa sebulan.tp skrg ni, lawyer claimed semua delay tu sbb bpp.

Sy dah tanya hal ji pd lawyer.dia kata x blh claim sbb delay tu dr bpp.blh sesiapa explain pd sy apa exactlt maksud klausa tu?sbb yg sy faham, lepas extended completion date, extend lg 14 days..then kalau x setel jgk buyer kena bayar 8% tu.

Master title ke individual title ni? drawdown by buyer's financier akan ada 2x. first for the redemption and second the balance. kalau loan sis dari bahagian pinjaman mmg timeframe settlement lama.. kita banyak kes redeem dari bahagian pinjaman kat sini.. sampai begaduh2 last2 soh customer gi sendiri ke bpp. tu pun x cepat jugak..

dalam kes ni, completion date SPA dalam masa 3 bulan dari tarikh SNP.. akan ada auto extension for 1 month yang akan di charge late payment interestnye kepada purchaser. tapi kene tgk jugak, siapa yang contribute kelewatan sampai tak boleh disburse both redemption and balance purchase price on time.. seme transaction ada timeframenye. i.e, nak dapat redemption statement, return documents dari financier seller, baya stamp duty, financier purchaser disburse. seme ada time frame. maknenya kalau kelewatan tu dari purchaser, seller leh claim interest for late payment of balance purchase price dari purchaser, atas duit yang belum disburse lagi, selepas habis completion date..

lagi satu dengan BPP ni, untuk balance purchase price tu, unlike other bank, depa nak tunggu geran umah tu register atas nama pembeli (kalau title case) collected and surrendered to them baru depa akan release duit balance.. kalau bank2 lain.. lepas loyer present je, serahkan pada land office, hari yang sama dapat penyata perserahan, dah boleh advise bank untuk release dah.. rumah ni landed ke strata?

kes ni dah auto extension, so dah extended jadi 23 Nov..bank purchaser dua kali kan.. 1 untuk redempiton, sy hantar sendiri redemption statement ke off lawyer pd 23 Sept, then, 25hb oct, lawyer issued cheque balance settlement pd BPP, Saya call BPP dlm 27hbOct mcm tu, officer kata checque dah clear, cuma diorang kena check jumlah payment sama tak balance, sebelum release geran. Dan pd 1 dec hari tu, sy ke BPP, officer kata kes dah selesai 20th Nov. Yg sy geram, selama 10 hri, dr 20Nov sampai 1 dec tu, lawyer x de buat follow up pun kat BPP. In fact, 1 dec tu, depa just hantar surat ke BPP, tp x follow up. Yg bg saya, sepatutnya, diornag kena check la status mcmmana, bukan main tinggal surat ja. Itu yg sy geram.

Diorang claim BPP yg lambat, bank cepat.. kalaau tgk date tu lebih kurang je masa yg diambil, cuma BPP lambat pos surat, which is sy rasa kalau lawyer betul2 follow up, mesti dapat save xtra 10 days tu.

mintak surat dari bpp ke lawyer's office tu, tgk depa chop receipt bape haribulan.. BPP ni, kadang2 record mmg la dah settle pada sekian haribulan.. tapi sementara nak gi mailing room, nak despact out tu mau seploh hari .. so now, u kene check ngan loyer tu, bila dia dapat geran dari bpp, i suppose individual title la ni. lepas dia dapat geran, kalau ada Loan lawyer, dia kene bagi geran, discharge form, cukai tanah pintu current etc to loan lawyer.. loan lawyer akan stamp loan dox purchaser pastu hanta presentation (tukar nama geran kat land office). lepas dah dapat presentation statement tu, kalau buyer bkn amik BPP jugak, dah boleh advise bank to release.. yang pasal late payment charges tu, ada jangkamasa diberi pada BPP untuk issue redemption statement dan geran seme tu balik to the lawyer.. its 14 days, mcm dalam clause yang u paste kat ateh tu. kalau lewat dari 14 hari, u tak leh charge to purchaser..

Akak tunggu hampir satu tahun untuk dapat duit jual rumah. Kenangan manisnya sebab akak berjaya jual rumah tu setelah melalui saat pahit dengan para penyewa. Jadi memang kena bersabar dan rajin2 call ejen.

wslam. sorry, baru nampak ni ha.. selalu utk bank release, kalau documentation dah complete, bank dalam seminggu or seminggu lebih dah boleh disburse dah. depends on bank jugak. tapi most bank seme dah cepat. loyer kena rajin2 la follow up.  kalau advise untuk release redemption, lepas tu ada beberapa proses lagi la, selalu kalau takde hickups dari bank penjual utk pulang documents, stamping semua tak ambil masa lama. daripada keluar duit redemption tu kalau cepat sebulan atau sebulan lebih sikit dah boleh settle semua.. kalau dah advice utk balance, dalam 2 minggu tu dah boleh settle dah..
