（吉隆坡27日讯）卫生部今日向国会下议院提呈《2012年传统及辅助医药法案》一读，其中无牌医师及发出误导性资讯广告的业者，可面对最高罚款3万令吉及监禁2年，或两者兼施。
无牌执业者首次在该法案第25（2）条文下，一旦罪成可被判罚款不超过3万令吉、监禁不超过2年，或两者兼施；重犯者的最高罚款为5万令吉、最高监禁3年，或两者兼施；法庭也可諭令传统及辅助医药理事会在被告罪成后的2年內不允许无牌执业者註册。
业者在刊登聘僱或宣传广告时，若在价格、质量等方面给予误导性资讯，可被判罚款不超过3万令吉、监禁不超过2年，或两者兼施；重犯者最高罚款为5万令吉、最高监禁3年，或两者兼施。
由卫生部副部长拿督罗斯娜提呈国会下议院的《传统及辅助医药法案》，將涵盖华、巫、印三族传统医药、顺势疗法及其他辅助性的疗程，但牙医专业並不包括在內。
吊牌3年可再申请
较早前，传统及辅助医药业者须遵守《1998年私人保健设施和服务法令》条文。
此外，若註册医师在可被判监禁的罪行下被判罪成、学歷资格被撤回或出现精神问题，该法令第27条文赋权理事会吊销业者的註册，惟业者可致函部长上诉及挑战理事会决定。然而，第28（1）条文阐明，执照被吊销者也可在执照吊销3年后重新提出申请。
另外，该法案一旦落实，所有传统及辅助医药业者有责任將患有突发性疾病的病人转介绍给医生，否则可被判停止营业或吊销执照。然而，顾客可通过书面通知，要求传统及辅助医药业者无需將他转介绍到其他机构。该法案下也將成立传统及辅助医药理事会，理事会须擬定確认该领域各行业所需资格、註册医师所需学歷、擬定学徒所需进行的训练、责任及可进行活动、发出註册证明、擬定行业守规、如各种惩罚。
理事会设调查机制
卫生部总监將出任有关理事会主席，成员包括不超过3名卫生部代表、2名本地大学专科代表、不超过3名公共服务註册医师、不超过8名私人界传统及辅助医药团体代表及5名相关领域的资深代表。该法令也要求理事会设立调查机制，以对被投诉的註册业者展开调查。
另外，该法案第22条文阐明，所有欲註册成为註册执业者的暂时註册业医师，需在大马任何医院或机构进行不少过1年的训练，而理事会若对该业者的表现不满，则可延长其训练不超过1年。
根据第22（10）条文，若理事会认为某人在该行业內有足够经验及知识则可给予豁免。
有关执业执照有效期为1年，业者需在执照到期后的不超过30天內更新其执照。
理事会也可对违规註册医师採取纪律行动包括暂时吊销註册、停职或是要求业者重新接受培训。
