Sirul Dan Azilah Bebas Tuduhan Membunuh Altantuya

KUALA LUMPUR 22 Ogos - Rayuan dua bekas anggota polis dari Unit Tindakan Khas (UTK) terhadap sabitan dan hukuman mati atas kesalahan membunuh wanita Mongolia, Altantuya Shaariibuu akan diketahui di Mahkamah Rayuan, Putrajaya esok.


Bekas Cif Inspektor Azilah Hadri, 34, dan bekas Koperal Sirul Azhar Umar, 38, mengemukakan rayuan setelah tidak berpuas hati dengan keputusan Mahkamah Tinggi Shah Alam pada 9 April 2009 yang menjatuhkan hukuman itu terhadap mereka.

Kedua-duanya didapati bersalah atas tuduhan membunuh Altantuya, 28, di antara pukul 10 malam, 19 Oktober dan 1 pagi, 20 Oktober 2006 di antara Lot 12843 dan Lot 16735, Mukim Bukit Raja, Klang, Selangor.

Bekas penganalisis politik, Abdul Razak Baginda, 50, yang dituduh bersubahat dengan mereka, dibebaskan oleh Mahkamah Tinggi pada 31 Oktober 2008 apabila pihak pendakwa gagal membuktikan kes prima facie terhadapnya.


Rayuan Azilah selaku perayu pertama dan Sirul Azhar, perayu kedua telah didengar selama dua hari pada 24 Jun lalu di hadapan panel tiga hakim dianggotai Datuk Seri Mohamed Apandi Ali, Datuk Linton Albert dan Datuk Tengku Maimun Tuan Mat.

Pada pendengaran rayuan tersebut, peguam Datuk Hazman Ahmad yang mewakili Azilah dan peguam, Kamarul Hisham Kamaruddin yang mewakili Sirul Azhar berkata, hakim perbicaraan melakukan kekhilafan serius dari segi undang-undang dan fakta ketika mensabitkan kesalahan dua perayu berkenaan.

Court frees Azilah, Sirul of Altantuya murder charge

The Court of Appeal today freed Special Action unit officers, Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar, of the charge of murdering Mongolian translator Altantuya Shaariibuu.
This follows the court in a unanimous decision to allow the duo's appeal in the sensational case.

However, the prosecution will have the opportunity to appeal at the Federal Court - the country's highest court.

Justice Md Apandi Ali is leading the three-member bench. However, the judgment was read by justice Tengku Maimun Tuan Mat who ruled there was serious misdirection by the High Court judge.


The misdirection included the non-calling of DSP Musa Safri, and the failure to produce the police station's diary which states that Azilah (left) was at Bukit Aman at the material time.
The other judges were justices Linton Albert and Tengku Maimon Tuan Mat.

Shah Alam High Court judge Md Zaki Yassin had on April 2009 convicted the two cops or murder however acquitted political analyst Abdul Razak Baginda of abetting with the murder.

Azilah is represented by Hazman Ahmad and J Kuldeep Kumar, while Kamarul Hisham Kamaruddin and Hasnal Rezua Merican appeared for Sirul.

Deputy solicitor-general III Tun Abdul Majid Tun Hamzah led a team of prosecutors that also comprise of DPP's Manoj Kurup and Noorin Badaruddin.

Altantuya was murdered in the forest of Puncak Alam near Shah Alam between 10pm on Oct 19 and 1am on Oct 20, 2006.
According to the lawyers, the two accused could be released from Sungai Buloh prison later today.
