salam semua...i have a question lah...is there a law in malaysia that says employer must allow muslims to go for their prayers?

interesting soalan...pada saya, walaupun employer tak bagi solat masa keje, employee bole arrange break time to suit the prayer time..contoh kalu time zuhur, memang time break kan...so amik la break between 1-2..enuf time for zuhur...

sembahyang jumaat memang ada law yang stated, kena bagi perlepasan untuk pekerja lelaki untuk menunaikan solat jumaat...dapat 1 1/2 jam perlepasan...

kalo situation mcm yg u mentioned tu, ok, shdnt be a problem...

maybe i shd tell the story that leads to my question...i had an interview last week with this one co..its a group of cos privately owned by this lady and her children...the interview went well despite the fact that she told me she doesnt fancy women who wear veils cos they tend to smell until she asked me this one question.. are u going to stop for a prayer if we had a meeting going on? (i am to be in the meeting to take minutes) i said if the mtg stretch until the next prayer time is nearing then i have to stop... she said, no no no... u must see work as ibadah too... it is ok to leave ur prayer cos ur doing another ibadah...if u leave ur prayer to finish watching ur favourite show on tv, yes dats wrong...anyway, it is only once in a while.. i said true, work is ibadah but solat comes first, im sorry, i cannot  do dat...she then came up with reasons y she couldnt take me in... she said whes worried abt the distance from my house to the officelah, n dat i have been in my comfort zone for too long n that i am going to have a clash in views with her...i said, ok....but i know the only reason is dat cos i disagree with her and did not abide by wat she wants.. and believe it or not, she herself is a muslim.. i understand that shes a mix, chinese and malay...i dont think any non-muslim dare to say such thing out loud like dat cos its a very sensitive issue...dats y i want to know whether theres any law pertaining to this prayer matter...kalo ada, i want to write to her..

hi iman...masalah nyer sekarang..banyak kes our fellow sisters in islam..amik kesempatan atas kelonggaran untuk menunaikan solat dengan membuat perkara2 lain...berniaga la..tido la..makan2..berborak..this kind of people that actually give a bad impression to the rest of us muslims.

remarks that employer pasal women pakai veil smells...i guess itu dah kira hygiene issues individuals...ada yang memang jaga penampilan dengan bertudung...smell, probably body odour..or maybe serkup kepala yang tak serap peluh yang menyebabkan ianya berbau..dan jenis orang yang suka berambut panjang, tapi bila cuci rambut malas nak tunggu rambut kering..terus pakai tudung..salah sapa..salah individu bertudung gak..akhirnya..di jadikan contoh oleh orang2 macam yang interview u tu

its a good thing that she point out situations and you did give your firm and honest answer. pasal tinggalkan meeting sebab stretch hingga next prayer time tu..well, you can always use technology..nowadays bole record guna digital camera atau guna recorder...to record the discussion..kalau nak bagi alasan meeting sampai kena qada'..well itu memang tak bole di jadikan excuse..

i guess...wallahualam...ada sesetengah orang yang menganggap, jika Allah bagi kita qada' sembahyang..maknanya..jika ada keadaan tertentu, kita bole qada'..like she said..work is also ibadah..but given a choice..better perform the solat at its designated time..and to avoid as we might..to qada'..

hope to get feedback from others as well...i personally feel that kita semua kena ada our own quiet moment with ourself..and performing solat is one of them..just us..and our creator..sometimes, bole produce workers atau employee yang lebih berkualiti..

ada kenal sorang supplier..he is indian..and hindu..nak cari pekerja melayu...yang "SEMBAHYANG"..hehehe...pelik kan...non-muslim yang nak cari muslim worker yang sembahyang...

i guess, bila manusia...disiplin dalam usaha dia beribadat pada penciptanya...sudah tentu akan reflect pada kerja jugak...maksudnya dari segi displin diri tu..dan amanah dalam membuat kerja..

that woman is just ridiculous n crazy....jenis yg suka org ikut telunjuk dia...:@

i nk kupas sikit benda2 bodoh yg dia ckp...

1. psl org pakai tudung smells - abis org pakai tudung aje yg berbau? yg tak pakai tudung, tapi kalo tak jaga hygiene pun boleh busuk apa...n ada certain manusia, 10 kali mandi pun still bdn ada bau tak sedap.. yg tu ape cite lak?  i tgk rambut dia pun mcm berminyak2 jek... entah2 kalo dekat dgn dia rambut dia bau busuk gak...org punye busuk pandai le dia ckp, dia punye busuk dia tak tau...

2. psl boleh tinggalkan solat bila kerja - ni mazhab mana dia pakai i pun tak tau... setau i yg jahil ni, bila time prayer masuk, u kena tinggalkan apa saja yg u buat n perform d prayer immediately...n meeting tu apa la yg urgent or important sgt, sampai nk break 5 to10 minutes pun x bleh...kalo ada org sakit perut nk berak, dia kena berak kat kerusi aje ke sbb tak bleh tinggalkan mtg? kalo org bleh tinggalkan mtg 5 to 10 minutes utk pegi toilet and wat not, maknanya, org bleh stop kejap utk solat... kalo sendiri tu tak solat, lantak dia lah kan, ini kita nk solat tak kasi...heran betol ada wujud muslim mcm ni...

ape yg i nmpk, dia ni ada prejudice against islam... dia ckp, dia pun bljr gak psl islam but in her own time n kalo dia bljr , dia bljr betol2... oh puhlleaseee laa...kalo dh tak suka org pakai tudung n tak bg org solat, buat ape mangaku islam?

you got a point there...

pasal berbau tu..memang kadang2 orang ni tengok gak pemakanan..tu yang bole keluar ke peluh jadi hamis..

agaknya dia anggap call of nature tu memang fitrah manusia..tapi call to ibadah tu bukan fitrah..

susah gak kan..ni jenis pandai tak bole di ikot..bodoh tak bole di ajar..hopefully ada forumer yang bole dapatkan clause kat mana2 ke pasal repect of the individual religious beliefs...

rasanya takde peruntukan undang-undang.  walaupun aku berharap sangat ianya ada.

kalau dah tegur si pompuan tu, ok la.  setakat mana yang anda mampu, sudah la.  biar Tuhan uruskan yang lenlainnya.

i'm pretty sure there's none.  ni ikut budibicara majikan la.. chronologically,  its just like nak pergi toilet masa tgh keje. takkan nak larang...  (tho i know ada some places yg due to the nature of the job, kalau nak gi toilet pun kena ikut SOP bagai..).

Dear Iman...

ni aje yang i bole gali....

Yang paling related skali pasal bende ni ialah kat Akta Kerja 1955(Act 265).Tapi takde stated pun pasal g solat masa waktu bekerja ke.Yang ada pun pasal had kerja lebih masa, kadar elaun bersalin, waktu bekerja pejabat, rehat, solat jumaat..(solat hari-hari takde dinyatakan.So, terpulang ar kepada budi bicara boss tu sendiri.

Tapi dalam article 5, Bab G Waktu Bekerja dan Lebih Masa 1974 di bawah perlembagaan persekutuan, ada ckp yang "seseorang pegawai yang hendak meninggalkan pejabatnya di waktu bekerja  hendaklah terlebih dahulu mendapatkan kebenaran daripada pegawai yang menjaganya sebelum berbuat demikian".Maknanya, kene bgtau ar kalau nak kuar mana including nak g solat.So kalau tak g tau, nanti sampai naik court ke, employer kite akan guna article ni ar untuk fight, sbb kite tak mintak kebenaran dia before pergi mana-mana.

yg heran nya apsal solat jumaat ada peruntukan, solat lima waktu yg lain takde? yg 5 waktu tu tak wajib ke? ape ke pelik punye undang2 ni? katanya islam agama rasmi...

aku tak puas hati sbb pompuan tu melampau...hal2 agama tu urusan dia dgn tuhan...ape dia pk aku kat situ nk mintak sedkah ngn dia ke... aku nk apply kerja je, tak sesuai sudahlah...takdenye aku nk merayu2 nk kerje situ...ade ke bila aku ckp sorry aku tak boleh tak pegi solat tu, dia tanye, wat r u, shiah or something? soklan gila apa ni?... dia indicate mcm aku ni extremist agama kat pakistan nun gamaknya... nk tergelak pun ada aku bila pk balik...sewel punye org...

kalo everytime nk solat kena bgtau , takde hal...boleh buat...

kalo dkt states sana, its illegal to ask/talk abt race, religion, gender, colour masa interview sbb tu semua discrimination... takkan kat malaysia takde law govern all this eh? kalo mcm tu, employer bermaharajalela lah..

Ermmm, dulu masa anis apply kerja kat syarikat tempat anis kerja ni, anis paling risau bab solat inilah...kemudian bila dipanggil interview, semasa diinterview tu dan anis ditawarkan untuk bekerja di situ, majikan tu tanya anis ada apa2 nak tanya tak, anis terus jawab...sini ada surau tak?...Pekerja muslim boleh solat tak?...Kalau semua ini tak ada, saya rasa saya tak sesuai untuk bekerja di sini..kuikuikuikui...Majikan/penemuduga tu pandang anis sambil tersenyum..Awak boleh solat ikut yang disuruh oleh agama awak, surau akan disediakan kalau ada permintaan dari staff muslim..Bila dia jawab mcm tu, anis terus setuju dengan tawaran kerja tersebut..

Alhamdulillah dah kerja sini belas2 tahun, tak pernah lagi majikan halang untuk anis tunaikan solat zuhur dan Asar, majikan orang cina dan free thinker.Dulu pernah interview kat satu satu syarikat melayu, ownernya orang melayu..masa interview dia tanya...kerja ini tak sesuai untuk orang yang bertudung sebab banyak habis masa di kilang...kalau awak sanggup buka tudung, awak boleh terus hadiri interview ini, jika tak sanggup, awak boleh balik...Terus anis angkat kaki..blahh...

thx anis for sharing ur experience...apa kaitan keje kilang ngn pakai tudung ni?..dlm kilang le bagus pakai tudung supaya rambut tak masuk/jatuh dalam or kena product...as i said, most likely non-muslim employer dont dare to prohibit muslims from solat ni, dia org respect jugak...kalo tak respect or tak suka pun, most of them telan je... dh dia cari mkn kat tanah melayu n negara islam kan?

actually, all this time i assume employer cannot disallow muslim employee to perform their prayer...especially kalo boss malay/muslim, they shd know better lah kan...so i kalo interview tak pnah ask question psl solat semua ni...

long lunch break untuk permudahkan umat islam tunaikan solat jumaat tu ada sebagai timbal-balik untuk hari ahad dijadikan cuti umum, kalau tak silap aku la.

walaupun tiada arahan rasmi/bertulis, biasanya majikan tak boleh halang para pekerja dari tunaikan solat.  kebebasan beragama dilindungi perlembagaan negara jadi kebanyakan majikan biasanya diam (tanda memberi izin) kalau kita keluar 5-10 minit untuk bersolat.  asalkan jangan kita salah-gunakan peluang ini, sudah lah.

kalau majikan halang jugak, cuba rujuk dengan peguam di biro bantuan guaman.  mungkin majikan ini boleh diheret ke mahkamah dan pihak media boleh bantu malukan majikan ini secara kaw-kaw.
