[Jenayah] DPP’s comments on 99% chance of conviction inappropriate, says Guan Eng

PETALING JAYA: Former finance minister Lim Guan Eng has slammed lead deputy public prosecutor (DPP) Wan Shaharuddin Wan Ladin who had said there will be a 99% chance of conviction for two new charges brought against the Bagan MP.

Calling Shaharuddin’s remarks as belligerent and inappropriate, he said the DPP had already prejudged him, threatening his right to a fair trial.

“Many have commented that the DPP’s public statements are potentially dangerous, can destroy a person’s reputation and prejudice my right to a fair trial,” Lim said in a statement.

Previously, the lead DPP said Lim’s new case was the “mother of all cases” compared with the three charges he was facing earlier.


When asked about the prosecution’s chances in the case, Wan Shaharuddin said the policy of the Attorney-General’s Chambers and the Malaysian Anti-Corruption Commission was that “we only prosecute cases where we have 99% chances of obtaining a conviction”, while (the remaining) 1% was left to an “act of God”.

Lim was charged with misappropriating government property amounting to RM208 million worth of Penang state land involving two companies.

In response, the Bagan MP and former Penang chief minister maintained that the charges were “baseless and illogical” as he had not derived any benefit.

“The land valued at RM208 million was payment in the form of a land swap in accordance with the agreement between the state government and the contractor.


”Further, the land was transferred after the final decision by the state executive council.“

Previously, Lim said the charges were related to the undersea tunnel and roads project, which was awarded through an open tender in 2013 and which the Malaysian Anti-Corruption Commission had questioned him on five occasions.

He insisted that he was not involved in the tender process.

Lim is now facing a total of five charges for offences allegedly made during his tenure as Penang chief minister.
