DNA found on diaper in child sodomy casePosted on 21 August 2013
GEORGE TOWN (Aug 21, 2013): A State Chemistry Department chemist testify at the Sessions Court today that there were two sets of DNA found on a diaper of the three-year-old who was allegedly sodomised by a 24-year-old shopkeeper. Padillah Yahaya said the source of the DNA samples, however, could not be determined. "DNA samples can be obtained from the saliva, blood, skin or roots of the hair," she said when cross-examined by Deputy Public Prosecutor S. Selvaranjini. She said that there were blood stains and semen found on the accused's underwear. Padillah added that she had, on Aug 8, 2012, received 16 samples to be tested for DNA, which include clothes of both the accused and victims, and some cotton swipes. She added that the samples were kept in cold storage to preserve them. She also told the court that the probability of the DNA profile tested to belong to another person aside from the accused is very low. S. Mahendran was charged with raping and forcing unnatural sex on the minor between 12.50pm and 1.20pm at the girl's house in Bayan Lepas on Aug 4 last year. The offence, read under Section 377C of the Penal Code, carries up to 20 years' jail and whipping, if convicted. Sessions judge Zulhazmi Abdullah set Nov 20 and 21 for the trial to resume.
