Amaran supaya beri keterangan tidak memihak kepada tertuduh - Saksi
Seorang penuntut Universiti Pertahanan Malaysia (UPNM) memberitahu Mahkamah Tinggi di sini hari ini bahawa dia dan beberapa pelajar lain yang akan menjadi saksi dalam perbicaraan kes bunuh Zulfarhan Osman Zulkifli telah diberi amaran oleh pihak atasan UPNM untuk memberi keterangan di mahkamah yang tidak memihak kepada tertuduh-tertuduh dalam kes itu.
Ahmad Senabil Mohamad, 22, penuntut tahun tiga jurusan Pengurusan Sumber Manusia UPNM memberitahu demikian ketika pemeriksaan balas peguam Amer Hamzah Arshad yang mewakili tertuduh pertama dalam kes itu pada perbicaraan hari ke-15.
Amer Hamzah : Kamu dan pelajar-pelajar lain telah diberi amaran supaya tidak beri keterangan yang memihak kepada tertuduh-tertuduh. Setuju dengan cadangan saya.
Saksi pendakwaan Ke-24 itu juga bersetuju dengan cadangan peguam itu bahawa dia dan beberapa rakan seuniversitinya itu telah dipanggil oleh seorang pegawai atasan selepas seorang lagi rakannya iaitu Muhammad Izzul Akhtar Rosli, 22, selesai memberi keterangan di mahkamah sebagai saksi pendakwaan Ke-17.
Dia turut mengakui bahawa tujuan pegawai atasan memanggil kesemua pelajar tersebut kerana beliau tidak berpuas hati dengan keterangan yang telah diberi Muhammad Izzul Akhtar di mahkamah.
Ahmad Senabil turut memberitahu bahawa sebelum kes itu dibawa ke mahkamah, dia dan beberapa penuntut UPNM yang lain telah dipanggil oleh seorang pegawai penyiasat polis tentera untuk memberi keterangan berhubung kejadian itu.
“Proses beri keterangan dijalankan serentak dalam sebuah bilik di UPNM,” katanya yang menambah mereka kemudian diminta menandatangani satu dokumen yang disediakan pegawai tersebut.
Enam penuntut UPNM iaitu Muhammad Akmal Zuhairi Azmal, Muhammad Azamuddin Mad Sofi, Muhammad Najib Mohd Razi, Muhammad Afif Najmudin Azahat, Mohamad Shobirin Sabri dan Abdoul Hakeem Mohd Ali mengaku tidak bersalah terhadap pertuduhan membunuh dan bersubahat membunuh Zulfarhan Osman di bilik 04-10, blok penginapan asrama Jebat, UPNM antara 4.45 pagi dan 5.45 pagi, 22 Mei 2017.
Pertuduhan terhadap mereka, yang kesemuanya berusia 22 tahun, dibuat mengikut Seksyen 302 dan 109 Kanun Keseksaan yang memperuntuk hukuman mati mandatori, jika sabit kesalahan.
Mereka bersama 13 lagi penuntut lain turut didakwa atas pertuduhan dengan sengaja menyebabkan cedera terhadap mang-sa bagi maksud hendak memerasnya untuk mendapatkan pengakuan mencuri komputer riba, mengikut Seksyen 330 Kanun Keseksaan dibaca bersama Seksyen 34 kanun sama yang memperuntuk hukuman penjara maksimum tujuh tahun dan denda, jika sabit kesalahan.
Perbicaraan di hadapan Hakim Datuk Azman Abdullah bersambung 25 Okt.

Pihak UPNM memang nak kes ni hukum tertuduh ke? Naper tak boleh beri kebebasan bicara secara adil? Baru tahu yang benar dan salah.. Kenapa..mengapa...bagaimana..

KUALA LUMPUR: A witness told the High Court here that he and other National Defence University (UPNM) students had been warned by the university’s top management not to testify in favour of the accused in the murder of cadet officer Zulfarhan Osman Zulkarnain.
Ahmad Senabil Mohamad, 22, said this when cross-examined by lawyer Amer Hamzah Arshad, representing the first accused in the murder trial.
Senabil, who is the 24th prosecution witness, told the court that he and a few of his university friends were called up after the 17th witness, 22-year-old Muhammad Izzul Akhtar Rosli, had testified.
He also testified that several UPNM students, including himself, had their statements recorded by military police investigating the incident before the case went to court.
Six UPNM students — Muhammad Akmal Zuhairi, Muhammad Azamuddin, Muhammad Najib Mohd Razi, Muhammad Afif Najmudin, Mohamad Shobirin Sabri and Abdoul Hakeem Mohd Ali — had claimed trial to the murder and abetment in the murder of Zulfarhan Osman.
They were alleged to have committed the offences in room 04-10 of the Jebat hostel block of UPNM between 4.45am and 5.45am, on May 22, last year.
The charges against them, all aged 22, were made under sections 302 and 109 of the Penal Code, which carry mandatory death sentences upon conviction.
The six, along with 13 other students, were also charged with voluntarily causing hurt to Zulfarhan in an effort to get him to confess to the theft of a laptop.
The hearing before judge Datuk Azman Abdullah continues on Oct 25.

KUALA LUMPUR: A witness told the High Court here today that he and several other Universiti Pertahanan Malaysia (UPNM) students had been warned by the university's top management to not testify in favour of the accused in the murder trial of cadet officer Zulfarhan Osman Zulkarnain.
Ahmad Senabil Mohamad, 22, a third year Human Resource Management student, said this when cross-examined by lawyer Amer Hamzah Arshad, representing the first accused in the murder trial, which is in its 15th day today.
Amer Hamzah: You and other students were warned not to testify in favour of the accused?
Ahmad Senabil: Agree
The 24th prosecution witness also told the court that he and a few of his university friends were called up by a top management officer after one of their friends, Muhammad Izzul Akhtar Rosli, 22, testified in court as the 17th prosecution witness.
He agreed with Amer Hamzah that they were called up by the officer concerned because he (officer) was not happy with the testimony given by Muhammad Izzul Akhtar.
Ahmad Senabil also said that before the case came up in court, he and several UPNM students were called up by a military police investigating officer to give their statements on the incident.
"It was conducted simultaneously in a room at UPNM," he said, adding that they were then asked to sign a document prepared by the officer concerned.
Six UPNM students, Muhammad Akmal Zuhairi, Muhammad Azamuddin, Muhammad Najib Mohd Razi, Muhammad Afif Najmudin, Mohamad Shobirin Sabri and Abdoul Hakeem Mohd Ali have pleaded not guilty to the murder and abetment in the murder of Zulfarhan Osman at room 04-10, Jebat hostel block of UPNM between 4.45 am and 5.45 am, on May 22, 2017.
The charges against them, all aged 22, were made under Section 302 and 109 of the Penal Code which provides for the mandatory death sentence upon conviction.
They, together with 13 other students, were also charged with voluntarily causing hurt to the victim to make him confess to the laptop theft, under Section 330 of the Penal Code read together with Section 34 of the same code which provides for a maximum jail term of seven years and fine, if convicted.
The hearing before judge Datuk Azman Abdullah continues on Oct 25. — Bernama

Senabil telah di ugut oleh SI MOHD RAZI iaitu salah seorang bapa OKT
Si Izzul ni dari awal bagi keterangan di perbicaraan yg lepas dah buat darah aku menyirap dan kalau dia ada depan mata aku mahu aku ludah dia utk menunjukkan betapa rendahnya maruah harga diri dia
Kalau hang rajin bolehlah hang backlog thread ni setelah itu hang akan dpt tahu kenapa aku jaki sgt dgn si IZZUL |

i paham memihak kepada tertuduh tu macam bagi statement yang akan menyelamatkan tertuduh. Sebab statement dia haritu kan dia kata arwah nampak tak teruk sgt lepas kena kann..
