Siti Nurhidayah gagal dalam rayuannya selepas dijatuhi hukuman penjara tiga tahun akibat memeras ugut.

PETALING JAYA: Mahkamah Rayuan Victoria menolak rayuan seorang wanita warga Malaysia mendapatkan pembebasan awal selepas cuba memeras wang $1,000 daripada ibu bapa seorang bayi yang sedang nazak di Melbourne.

Siti Nurhidayah Kamal dijatuhi hukuman penjara tiga tahun kerana memeras ugut Mac lalu selepas cuba memeras wang daripada pasangan yang terdesak untuk mendapatkan semula telefon bimbit mereka yang hilang.

Difahamkan telefon berkenaan mengandungi ratusan gambar anak perempuan mereka, Amiyah yang berusia 11 bulan.

Awal bulan ini, dia merayu, dengan alasan hukuman penjara adalah berlebihan dan hakim daerah terbabit silap kerana menyifatkan penyesalannya tidak mengurangkan “kekejaman” perbuatannya.

Tetapi rangkaian ABC Australia melaporkan bahawa ketua hakim Anne Ferguson dan hakim Stephen McLeish tidak setuju.

“Hukuman itu tidak berada di luar jangkauan yang dibenarkan,” penyiar itu memetik hakim sebagai berkata.

“(Siti Nurhidayah) menyahut rayuan bantuan dari dua individu yang sangat rentan dan tertekan dengan mengambil kesematan ke atas mereka untuk mendapatkan keuntungan.”

Tambah mereka, Siti Nurhidayah tetap berkeras dengan ugutannya walau setelah menyedari penderitaan pasangan itu “ketika itu adalah sangat serius”.

“Seperti yang dikatakan hakim (mahkamah daerah), ia kejam dan menjijikkan.”

Siti Nurhidayah menghantar mesej kepada pasangan Jay dan Dee Windross selepas mereka meminta orang ramai untuk mencari telefon yang mengandungi beratus-ratus gambar anak mereka pada 2019.

Walaupun tidak pernah menyimpan telefon tersebut, dia tetap menuntut $1,000 dari pasangan itu walaupun diberitahu bahawa anak perempuan mereka sedang nazak.

Menurut ABC, keputusan mahkamah itu disambut baik oleh Jay yang berharap ia dapat meningkatkan kesedaran mengenai keadaan penyakit mitokondria anak perempuannya.

Katanya penderitaan yang disebabkan oleh jenayah Siti Nurhidayah masih berbekas.

“Ini hanya mengembalikan begitu banyak kenangan dan sebenarnya tidak kami undang,” kata Jay

A Malaysian woman at the centre of a sick hoax that left the parents of a dying girl heartbroken is wanted for questioning in her home country regarding an airline ticket scam.

Siti Nurhidayah Kamal, 24, left Malaysia in September before moving to a Melbourne sharehouse.

She is accused of trying to extort $1000 from Boronia couple Jay and Dee Windross after the pair lost a mobile phone containing priceless photographs of their dying 11-month-old daughter, Amiyah.

Mrs Windross accidentally left the phone in the bathrooms at Chadstone Shopping Centre over the Easter long weekend. When she realised she had lost it — and the only copies of pictures of her terminally-ill baby girl — the couple made an impassioned plea for the return of the phone.



Police allege Ms Kamal contacted the Windrosses on Tuesday night, demanding $1000 for the return of the phone. But she never had it. The couple spent the last night of little Amiyah’s life corresponding with the Malaysian national.

In court yesterday, Ms Kamal wiped away tears as she was told she will remain behind bars until her next hearing in July. She is charged with one count of blackmail by making unwarranted demands with menace.

Ms Kamal’s lawyers said yesterday that the 24-year-old has “never been in custody”, news.com.au has learnt several people from Malaysia claim she stole money from them.

The alleged victims sent screenshots of conversations with a woman they believe to be Ms Kamal. Police reports detail how a woman with the same name stole money from them when she posed as an AirAsia employee.

One police report lodged with Malaysian police in Kuala Lumpur accuses “Siti Nurhidayah Kamal” of taking money for tickets for six passengers to travel at a cost of 2895 Malaysia Ringgit ($A993).

Blackmailer jailed for three years after threatening family of dying child

The woman who blackmailed a Melbourne couple as their daughter lay dying in a hospital bed has been jailed for three years and will be deported upon her release.

Jay and Dee Windross created a social media campaign to track down their missing mobile phone, which contained irreplaceable photographs of 11-month-old Amiyah as she spent her final days in critical care in April last year.

As the Windross family were saying their final goodbyes to Amiyah, Mr Windross received a text message from someone claiming to have the missing phone.

The Samsung Galaxy S8 with a purple cover had been snatched from toilets at the Chadstone Shopping Centre over the Easter long weekend.

But Malaysian national Siti Nurhidayah Kamal, the woman messaging the grieving couple, never had their mobile phone, yet continued bombarding Amiyah’s father with relentless demands for $1000 cash.

They later found out Kamal, the 25-year-old daughter of a police inspector, was acting out a hoax. The phone has never been recovered.

On Tuesday, the County Court heard of the couple’s ongoing heartache and desperation to reclaim precious memories with their beautiful daughter who died on April 24.

Judge Elizabeth Gaynor was scathing in her sentencing of Kamal, describing her offending as a deliberate attempt to exploit people already experiencing the gravest of distress.

“That you should be inspired in the first place by such suffering to offend in this way, much less continue it as intensely as you did even after being told Amiyah was dying and then of her death, I find to be so reprehensible as to be amoral,” she said.

“I regard the objective gravity of this offending and your moral culpability to be of the highest order.

“You were entirely aware they were tending to their dying daughter.”

In a victim impact statement, Mr Windross described the “torturous course” of his daughter’s illness which began as a diagnosed failure to thrive in the early weeks of her life.

In October 2018, Amiyah went into respiratory distress and was rushed to the Monash Hospital as her health deteriorated. She spent 200 of her 338 days in hospital.

“Our hopes of seeing our daughter in happier and more positive times was ripped for us,” Mr Windross wrote.

“The fact I told you our baby was dying in my arms … wasn't a deterrent for you.

“You even baited me to respond to you with a threat that you'd wipe the phone if I didn’t respond.”

Police eventually arrested Kamal at her Springvale home on April 26.

The investigation later found that the 25-year-old had messaged Mr Windross 92 times in just 24 hours.

On Tuesday, the court heard Kamal had no criminal history but pleaded guilty to “unsophisticated” and “impulsive” offending.

Kamal had also only been in Australia for about eight months and in Melbourne for four months when the blackmail occurred.

Judge Gaynor said that despite her defence counsel revealing their client was in financial desperation, she found no evidence of this.

She sentenced Kamal to three years in jail with a minimum of two years.

She will be eligible for release in 2021 after already serving 326 days in custody.

Outside court, Amiyah’s mother said she was happy with the sentence.

Ms Windross said she hoped the focus would now return to reclaiming her daughter’s memory and the hospital staff who worked so hard to treat their little girl.

“I'm glad [Kamal] got what she deserved,” Ms Windross said.

“I want Amiyah to be remembered as an undiagnosed child, as a unicorn, and I want the focus to be on mitochondrial diseases, that's the suspected disease that Amiyah died of.

“That's where the attention should be placed.”

Ms Windross said if anyone still had her phone to please return it along with the previous memories it holds.

“The first payment I made was via online transaction to a bank account number in the name Siti Nurhidayah.

Next I made a payment in stages to the same account number until the amount (had been paid).

“(Later) I contacted AirAsia to know my flight ticket status but AirAsia informed us that the booking of the ticket was cancelled by the nominee without making any payment.”

A spokesperson for AirAsia confirmed the Facebook page Dayah Online AirAsia Ticketing was “indeed a scam”.

Kate, whose surname has been withheld to protect her identity, told news.com.au she paid almost $A680 for tickets after corresponding with the seller bearing the same name, but never received them.

She said her case had been reported to police in Malaysia.

Hashima Hasbullah is the Secretary General of non-profit organisation Consumers Front for Sabah, which handles consumer complaints when victims get no help from police. She is handling 163 cases for victims who say they were scammed out of more than $A34,900 by Ms Kamal. That includes 70 teachers and students attempting to buy tickets for a school trip.

Mr Windross said: “Not only was it a complete and utter waste of my time, it was interrupting my final moments with my dying daughter.”

In an emotional post on Facebook, Mr Windross wrote that little Amiyah died peacefully.

“It is with utter sadness that Dee and I inform everyone that Amiyah Victoria grew her wings at 2.05am on Wednesday morning. Amiyah’s last hours were spent peacefully and calmly, cuddling in Mummy’s and Daddy’s arms — which is what she loved most,” he wrote.

“Amiyah battled hard and fought from the day she was born. Her strength, her courage, and her unrelenting fight was on display from her first breath, all the way till her last.”

The Ringwood Magistrates' Court in April heard Kamal and her husband had been working as Uber Eats deliverers earning $120 a day.

Her lawyer, Royce Dekker, said the couple left their children in Malaysia and had been trying to make ends meet when they fell on hard times and couldn't pay the rent.

'They're earning more money than we are,' Ms Windross said. 'They earn more money then we've been living on on one wage each for 11 months and we have had to pay hospital bills, car parking - everything. Mortgage bills. And she's in there crying because they don't earn enough money.
